(4) Survival. This Section 1.9(b) will survive the applicable Closing <br /> Date and will be fully enforceable by the City after such applicable Closing Date. <br /> (c) Stormwater Management. <br /> (1) The City, following development of the Phil Johnson ballfields, is <br /> providing water quality treatment for Transfer Lot 45-A. After the Transfer Lot <br /> Group Closing Date, the City will, if and to the extent that the City develops the <br /> Transfer Lot Group, provide water quality treatment for the Transfer Lot Group. <br /> After the Transfer Lot Group Closing Date, the City will provide interim storm <br /> water detention for the Transfer Lot Group in the currently existing detention <br /> pond on Lot 45-D, but the City has no obligation to expand or otherwise improve <br /> the existing detention pond. The City shall continue such water quality treatment <br /> and interim storm water detention until such time as a regional drainage and storm <br /> detention facility plan for the Pigeon Creek No. 2 drainage basin is prepared by <br /> Owner and approved by the City as part of Owner's development of the Owner <br /> Property. Such regional drainage and storm water detention facility (the "Pigeon <br /> Creek No. 2 Facility") shall be sized to accommodate storm water detention <br /> requirements for: (i) Transfer Lot 45-A; (ii)the Transfer Lot Group based on the <br /> park plan attached as Exhibit E; and (iii) for Sievers-Duecy Boulevard. Unless <br /> determined otherwise by the City, the Pigeon Creek No. 2 Facility will be built, <br /> owned, operated and maintained by Owner and/or the Mountain View Business <br /> Centre Association's (the "Association") expense. Owner, at its expense, will <br /> replace and relocate the Shunt Pipes and provide the necessary pipes for <br /> connecting the stormwater drainage from the Transfer Lot Group and Sievers- <br /> 17 <br />
