complete work on Transfer Lot 3, and(ii)the Title Company shall return the <br /> Transfer Lot 3 Deed to Owner. <br /> (d) Remedies. The City retains all other rights and remedies that it may have <br /> in law or equity in the event of a Default(or a breach followed by the expiration of a cure period, <br /> if any) by Owner of the terms of the Development Agreement. <br /> 1.13 Insurance. <br /> (a) For the duration of the Development Agreement, Owner shall obtain at its <br /> own expense, maintain in full force and effect, and file with the City a Certificate of Insurance <br /> for a primary policy of Commercial General Liability insurance that includes the coverages set <br /> forth below. These policies and Certificates of Insurance shall be subject to approval by the City <br /> as to company,terms and coverages. <br /> (b) Such liability insurance policies shall by endorsement specifically name <br /> the City as an additional insured thereunder. Subject to the provisions of such policies, the <br /> insurance shall protect the City from any and all claims and risks and losses in connection with <br /> any activity performed by Owner on the Owner Property. <br /> (c) Such liability insurance policies shall provide the following minimum <br /> coverages (extended bodily injury, acts of employees, premises and operations liability, owner's <br /> and contractor's protective liability, blanket contractual liability, broad form property damage <br /> liability, personal injury and coverage for acts of employees, automobile liability, explosion, <br /> collapse, and underground damage) and minimum limits ($10 million per occurrence and $10 <br /> million annual aggregate). <br /> 1.14 Transfer Lot 3. In lieu of conveying Transfer Lot 45-E to the City, the City and <br /> Owner have agreed that Transfer Lot 3 will be conveyed to the City after completion of the <br /> 26 <br />
