RECEIVCJ <br /> APPEAL OF THE DECISION JUN 17 1985 <br /> OF THE HEARING EXAMINER, <br /> CITY OF EVERETT CI'T'Y CLERK <br /> TO: EVERETT CITY COUNCIL <br /> RE: APPEAL FOR HOME OCCUPATION PERMIT <br /> The decision for denial of my home occupation permit would not allow me the <br /> benefits of maintaining a profession, being self-supporting, and to be a <br /> homemaker, essential for a quality home life .- <br /> The Everett Hearing Examiner denied my appeal , but concluded that my request <br /> • for a Home Occupation Permit satisfied all the general requirements set forth <br /> in Section 19 .44.020. However, he stated that I "failed to adequately satisfy <br /> all the specific considerations as set forth in Section 19 .44 .030 ." Specifically, <br /> "the need for such home occupation to be located in a residential area versus <br /> a commercially zoned area", that my single chair salon would be "contrary to <br /> the intent of the ordinance to preserve the stability of the city's commercial <br /> areas" and that I "had not established any hardship related to the need for the <br /> beauty salon in order for it to be provided in the home." <br /> Hairdressers work on a commision basis . To lack a clientele and be required to <br /> sit during periods of non-productivity, does not allow in the earning of an <br /> income. Yet, I would still he required -to subsidize childcare for my infant <br /> son, thus creating a financial hardship. Also, salon working hours are assigned <br /> so as to allow maximum public usage; ie: Saturdays , late evenings , and are <br /> cause for family hardships due to a lack of family unity. To be required to <br /> operate strictly in the commercially zoned areas would most certainly necess- <br /> itate my hiring of additional help and the operation of a multi-chair business <br /> in order to defray the high cost of lease or rental space. It would be diffi- <br /> cult to find appropriate space with which to accomodate a single chair. This <br /> would also require many hours of work away from my family. It is my intention <br /> to be self-employed and self-supporting, but not an employer. The small home <br /> clientele I would require to be self-sufficient could not possibly contribute <br /> to the de-stabilization of the city's commercial areas . <br /> 7 <br />
