Section II. Definitions <br /> A. BODILY INJURY means physical injury, sickness or disease, sustained by any person, including death <br /> resulting therefrom or mental anguish, emotional distress or shock, sustained by any person. <br /> B. CLAIM means a monetary demand or notice, or assertion of a legal right alleging liability or responsibility <br /> on the part of any INSURED and includes a lawsuit, petition, or governmental or regulatory action <br /> commenced against any INSURED. <br /> CLAIM does not include any of the foregoing arising out of an act, error or omission in PROFESSIONAL <br /> SERVICES or a POLLUTION CONDITION reported under a prior policy issued by the Company or any <br /> entity affiliated with the Company. <br /> C. CLIENT means the person or organization that directly hires the NAMED INSURED, by written contract <br /> signed by the NAMED INSURED, to render CONTRACTING SERVICES and for whom the NAMED <br /> INSURED renders such services. <br /> D. CONTRACTING SERVICES means those activities listed in Item (6) of the Declarations that are rendered <br /> by or on behalf of the NAMED INSURED. <br /> E. COMPLETED OPERATIONS means CONTRACTING SERVICES that are completed. <br /> COMPLETED OPERATIONS does not include CONTRACTING SERVICES that have been abandoned. <br /> CONTRACTING SERVICES will be deemed completed at the earliest of the following times: <br /> 1. when all CONTRACTING SERVICES to be performed under the contract have been completed; or <br /> 2. when all CONTRACTING SERVICES to be performed at the JOB SITE have been completed; or <br /> 3. when that portion of the CONTRACTING SERVICES have been put to its intended use by any <br /> person or organization other than another contractor or subcontractor working on the same project. <br /> CONTRACTING SERVICES that may require further service, maintenance, correction, repair or <br /> replacement, but are otherwise complete, shall be deemed completed. <br /> F. EMERGENCY REMEDIATION EXPENSE means reasonable and necessary REMEDIATION EXPENSE <br /> incurred on an emergency basis at a JOB SITE to address a POLLUTION CONDITION resulting from the <br /> rendering or failure to render CONTRACTING SERVICES, which the Company deems reasonable and <br /> necessary to mitigate the immediate effects of the POLLUTION CONDITION. <br /> G. ENVIRONMENTAL DAMAGE means physical damage in or upon land, the atmosphere, watercourse, <br /> body of water or groundwater, caused by a POLLUTION CONDITION and resulting in REMEDIATION <br /> EXPENSE. <br /> ENVIRONMENTAL DAMAGE does not include PROPERTY DAMAGE. <br /> H. EXTENDED REPORTING PERIOD means the Automatic Extended Reporting Period or, where applicable, <br /> the Optional Extended Reporting Period, as set forth in Section V. Extended Reporting Period. <br /> INSURED means each of the following: <br /> 1. Any NAMED INSURED, and any current or former director, partner, member, executive officer, <br /> employee or LEASED WORKER of the NAMED INSURED, but solely while acting within the <br /> course and scope of his/her duties as such. <br /> PCPocCP 0713 ©2013 X.L.
