3rd Avenue SE - ' 16 of Consolidated Proposal CITY OF EVERETT, WASHINGTON RESOLUTION NO. 67.2 A RESOLUTION of the City Council of the City of Everett, Washington, declaring its intention to order the improvement of 3rd Avenue SE, from Everett Mall Way, south to 104th Street SE, with complete standard street system improvements, and including a storm water system, and a 12 inch water line from Everett Mall Way, south to 104th St., and an 8 inch water line from 104th St. to 105th Street, and transit shelters and pull outs, and property acquisition; and necessary appurtenances as determined by the City Engineer in connection therewith and to create a local improvement district to assess the cost and expense of carrying out such improvement against the properties specially benefitted thereby, and notifying all persons who desire to object to the improvements to appear and present their objections at a meeting of the City Council to be held on February 20, 1985, at 7:00 p.m. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT, WASHINGTON, as follows: Section 1: RCW 35.43.040 provides that the legislative authority of a City may order a local improvement district. Section 2: It is the intention of the City Council of the City of Everett, Washington, based on RCW 35.43.040, to order the improvement of the following property: See Exhibit "A" which is attached hereto and incorporated by reference herein. by the construction and installation of: 3rd Avenue SE, from Everett Mall Way, south to 104th Street S.E., with complete standard street system improvements, and including a storm water system, and a 12 inch water line from Everett Mall Way, south to 104th St., and an 8 inch water line from 104th St. to 105th Street, and transit shelters and pull outs, and property acquisition, and necessary appurtenances as determined by the City Engineer in connection therewith. Section 3: The total estimated cost and expense of the improvement is declared to be $800,800 and the entire cost and expense of such improvement shall be borne by, and assessed against, the property specially benefitted by such improvement to be included in a local improvement district to be established embracing as near as may be all property specially benefitted by such improvement, except that the City Water Fund No. 401 shall contribute a cost equivalent to the cost of the 8 inch water line, from 104th Street to 105th Street, and except City Transit Funds shall contribute the entire cost equivalent to the cost of the transit shelters and pull outs, and necessary right-of-way related thereto, and except any public contributions determined by City Council, if any, that may become available to help defray the cost of this improvement.
