111 RESOLUTION A RESOLUTION segregating an assessment for ULID No. 1, formerly LID No. 707. WHEREAS, the City of Everett has been requested by the owner of property known as Treasurer's Account No. 0006 and 0007 in ULID Roll No. 1, formerly LID No. 707, to segregate the assessment of said Treasurer's Account No. 0006 and 0007 into separate assessments, and WHEREAS, the requested segregated properties are of sufficient value to provide adequate security for the payment of the total assessment chargeable against the undivided parcel of property, and WHEREAS, RCW 35.44.410 and Ordinance No. 299-74 provide a method of segregating a tract of land in a ULID into smaller parcels, and WHEREAS, it is in the best interest of said ULID and the City of Everett to segregate said Treasurer's Account No. 0006 and 0007 into the separate parcels, and WHEREAS, the one hundred and twenty dollars ($120.00) as required by Ordinance No. 299-74 has been paid to the City Treasurer as a fee for the segregation ordered herein, and WHEREAS, Ordinance No. 930-83, adopted March 17, 1983, adopted the Final Assessment Roll for ULID No. 1, formerly LID 707, and said Final Assessment Roll was appealed to Superior Court in Cause No. 83-2-01284-6 resulting in an order placing restrictions on development and modifying the assessment of Treasurer's Account No. 0006 and 0007. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT: Section 1: That the City Treasurer is directed to make a segregation on the original Modified Assessment Roll ULID No. 1, formerly LID No. 707. Section 2: That the segregation shall be made as nearly as possible on the same basis as the original assessment was levied. Section 3: That the total of the segregated parts of the original modified assessments shall equal the assessment before segregation. Section 4: That the original tract and modified assessment known as ULID No. 1, formerly LID No. 707, Treasurer's Account No. 0006 and 0007 was fixed by Superior Court in Cause No. 83-2-01284-6 in the amount of $65,000.
