� � <br /> For valuable consideration, receipt and sufficiency of which is hereby <br /> acknowledged, the Grantors grant and convey to the Grantee, an easement <br /> for Private sewer line nurposes only; unon, over and across that portion of Lot <br /> 1 which is legally described as: <br /> The East 30.00 feet of the North 15.00 feet of Lot 'f, City of Everett Short <br /> Subdivision No. 1202-002003 as recorded under Recording Number <br /> 200803215004, records of Snohomish County, Washington. <br /> (SEE M,4P EXHIBIT `A' ATTACHED) <br /> 3. PURPOSE QF EA�EMENT <br /> Grantee shall be entitled to ingress and egress along with the right to <br /> construct, install, maintain, repair and replace utilities and appurtenances over, <br /> under and across the described easement area. <br /> 4. MAINTENANCE <br /> Grantee shall promptly repair and restore at his or her sole cost any and all <br /> improvements disturbed or damaged by him or her, or his or her agents in the <br /> construction or repair of any improvements upon the Owner's property and to <br /> return lands to the same or better condition than they were prior to the <br /> commencement of such improvement or repair. <br /> 5. GENERAL PROVISIONS <br /> a. Bindinq Effect <br /> This Agreement shall be binding upon and inure to the benefit of the parties <br /> and their successors, heirs, assigns, and personal representatives and all <br /> persons claiming by, through or under the parties hereto. The Easement <br /> created shall be appurtenant, sha11 touch and concern the real property <br /> described herein, and shall run with the land. <br /> b. Applicable Law <br /> This Agreemant shall be governed by and construed in accordance with the <br /> laws of the State of Washington. Jurisdiction and venue of any suit arising out <br /> of or related to this Agreement shall be exclusively in the state and federal <br /> courts of Snohomish County, Washington. <br /> c. Attornev's Fees <br /> In the event that any suit or other proceeding is instituted by either party to this <br /> Agreement arising out of or pertaining ta this Agreement or relationship of the <br /> parties, including but not limited to filing suit or requesting an arbitration, <br /> mediation or other alternative dispute resolution process (collectively <br /> "Proceedings"), and appeals and collateral actions relative to such a suit or <br /> Proceeding, the substantially prevailing party as determined by the court or in <br /> the proceeding shall be entitled to recover its reasonable attorneys' fees and <br /> � � <br /> Il � <br />
