1 RESOLUTION NO. c.,"?-/3 7 <br /> 2 <br /> 3 A RESOLUTION establishing procedures for variances from the City of <br /> Everett Noise Code. <br /> 4 <br /> 5 WHEREAS, the City's Noise Control Ordinance (Ordinance No. 534-78 as <br /> 6 amended) governs the quality, nature, duration and extent of discharge of noise within <br /> 7 the City; and <br /> 8 WHEREAS, Section 9 of Ordinance No. 534-78 authorizes the Noise <br /> 9 Administrator to grant variances pursuant to rules and regulations promulgated by City <br /> 10 Council; <br /> 11 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL that the <br /> 12 following rules and regulations shall govern the application for and granting of <br /> 13 variances from the City of Everett Noise Code: <br /> 14 1. Any person who owns or is in possession of any property or use, or any <br /> 15 process or equipment, may make a request for a variance to the administrator as <br /> 16 established in EMC 20.08.130 for relief from any provision of the City's Noise Code, <br /> 17 Ordinance No. 534-78 (as amended), governing the quality, nature, duration or extent of <br /> 18 discharge of noise. <br /> 19 2. The application for a variance shall be accompanied by a non-refundable <br /> 20 application fee in the amount of one hundred dollars ($100) and also accompanied by <br /> 21 such information and data as the administrator may require. <br /> 22 3. Besides any additional information and data required by the administrator, <br /> 23 the applicant shall submit a list of property owners and mailing addresses of all property <br /> 24 owners within five hundred feet (500') of any portion of the boundary of applicants <br /> 25 property. Depending upon the nature of the variance requested, the administrator is <br /> 26 hereby authorized to increase or decrease the five hundred foot limitation. <br /> 27 4. Once all required information and data is received and the application fee <br /> 28 is paid, the administrator shall circulate the application and the information or a <br /> 29 summary thereof, to the property owners whose names have been submitted to the <br /> 30 administrator as well as to any City departments and other governmental agencies <br /> 31 which may be affected by the variance request.
