PROCEDURAL POSTURE OF CASE . <br /> 15 The Municipality of Renton in this cause seeks to enforce its <br /> 16 ordinance as enacted and amended to abate as a nuisance, per se, <br /> 17 the exhibition of certain sexually explicit films by defendant <br /> 18 corporation in a theatre , located at 507 South Third Street, <br /> 19 Renton , Washington . The defendants also sought to have Renton <br /> 20 enjoined from enforcement of its ordinance and have the same <br /> 21 declared unconstitutional in a U .S . Federal District Court of <br /> 22 Western Washington Cause No . C82-59 M. Playtime Theatres Inc. et <br /> 23 al . v. City of Renton, _et al . After extensive evidentiary <br /> 24 hearings , that challenge was denied by U .S. District Court Judge <br /> 25 Walter. F. McGovern and an appeal has been taken from the decision <br /> 26 to the U .S . Ninth Circuit Court of Appeals and is presently <br /> 27 pending . This court has accorded deference to the U .S .
