J' <br /> RESOLUTION NO. 2+"0 7 <br /> A RESOLUTION adopting the procedure for the implementation of the <br /> deferral provided in Section 8 of Ordinance No. 812-81. <br /> WHEREAS, Ordinance No. 812-81 created LID 709 and established deferred <br /> payments for economically disadvantaged property owners as defined in said ordinance; <br /> and <br /> WHEREAS, Section 8(D) of said ordinance authorized the City Engineer to <br /> develop procedures for the full implementation of the deferral provided in said <br /> ordinance; and <br /> WHEREAS, the City Council finds that the City Engineer recommends that the <br /> City Council adopt the following procedures for the implementation of the deferral: <br /> 1. The single family property owners within the benefit area of <br /> LID 709 be notified of the deferral program and be requested to <br /> submit a request for a deferral along with supporting documents to <br /> the City Engineer, if they choose to apply; <br /> 2. The City Engineer shall review the applications for deferral in light <br /> of the requirements set forth in Section 8 of Ordinance No. 812-81. <br /> If the applicant meets the requirements, the deferral will be <br /> granted. If the applicant does not meet the requirements, the <br /> deferral will be denied; <br /> 3. Any party wishing to appeal the determination of the City Engineer <br /> must make a written request for an appeal. The request must <br /> specifically set forth the basis for the appeal and must be filed <br /> with the City Engineer within ten (10) calendar days following the <br /> mailing of the written notice from the City Engineer notifying <br /> them that their deferral application has been denied; <br /> 4. The City Engineer will appoint an individual to act as Hearing <br /> Examiner for purposes of holding hearings on the appeal of the <br /> denial of any deferral requests. The Hearing Examiner shall make <br /> findings and a decision either affirming or reversing the decision of <br /> the City Engineer. <br /> The Hearing Examiner will notify both the appellant and the City <br /> Engineer of his decision; <br /> 5. The decision of the Hearing Examiner shall be final. There shall be <br /> no appeal from the Hearing Examiner's decision. <br /> and; <br /> WHEREAS, the City Council finds that the Public Works Department has met <br /> with the City's Finance and Budget Committee to discuss the issue of said <br /> implementation and the City Engineer's recommendation is made with those discussions <br /> in mind; <br />
