Al <br /> RESOLUTION NO. € 3/ 7 <br /> WHEREAS, application was made for a Special Property Use <br /> Permit by the State of Washington to allow construction of 96, 000 <br /> sq. ft. of office space to be leased primarily to the Department <br /> of Social and Health Services on a 5 . 8 acre site on the north- <br /> west corner of Highway 99 North and Tower Street; and <br /> WHEREAS, a public hearing was held before the Land Use <br /> Hearing Examiner on November 17 , 1983, and at this hearing public <br /> testimony was received; and <br /> WHEREAS, the Fearing Examiner made findings and conclusions, <br /> and issued a Special Property Use Permit for the above-described <br /> use with twenty-three conditions which are hereby attached; and <br /> WHEREAS, the Applicant is appealing Conditions No. 2 , 4 and <br /> 21 of the Hearing Examiner' s decision; and <br /> WHEREAS, the Everett City Council has reviewed the Hearing <br /> Examiner' s Findings, Conclusions and Decision and has also <br /> reviewed the appellant' s reasons for appealing Conditions No. 2 , <br /> 4 and 21. <br /> NOW, THEREFORE, BE IT RESOLVED that the Everett City Council <br /> hereby reaffirms the Hearing Examiner ' s findings, conclusions and <br /> decision, and denies the Applicant ' s appeal of Condition No. 2 . <br /> FURTHER, BE IT RESOLVED as to Condition 21 that the following <br /> finding be adopted: <br /> The matter of resolving the access issue is a <br /> private matter between the private property <br /> owners to the north and the owners of the subject <br /> property. The Hearing Examiner' s requirements <br /> as they relate to this issue may possibly place <br /> the City in the position of either having to <br /> resolve the issue itself or precluding the <br /> project from advancing. <br /> NOW, THEREFORE, Condition 21 should read as follows: <br /> The subject property shall not be developed to <br /> preclude improvements to perfect access rights <br /> to private residents to the north should their <br /> right of access be obtained. In the event there <br /> are improvements to establish the access, there <br /> shall be maintained a minimum of five feet of <br /> landscaping between access to private parcels to <br /> the north and the subject property, or, if access <br /> is through the subject property parking lot, a <br /> gate shall be placed in the fence by the applicant <br /> to facilitate access. <br />
