s r <br /> 1 WHEREAS, paragraph 3 of the 1974 Agreement provides that acquisition or <br /> 2 conveyance of properties by the City shall be pursuant to the Agreement, and that the <br /> 3 City may transfer any interest in the property acquired hereunder by deed rather than <br /> 4 by vacation; <br /> 5 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> 6 OF EVERETT that the City of Everett decline to accept from A. A. Wexler and <br /> 7 Gilda J. Wexler, his wife, the equivalent forty (40) foot right-of-way easement, <br /> 8 together with $6,000.00 and six percent (6%) interest thereon since 1975, as compen- <br /> 9 sation for vacated Lake Street. <br /> 10 BE IT FURTHER RESOLVED that the City of Everett accept from A. A. Wexler <br /> 11 and Gilda J. Wexler, his wife, a sum not to exceed one-half the current appraised value <br /> 12 of vacated Lake Street pursuant to RCW 35.79.030. <br /> 13 BE IT FURTHER RESOLVED that immediately upon payment to the City of <br /> 14 Everett of such sum, not to exceed one-half the current appraised value of vacated <br /> 15 Lake Street, the City release and quit claim all right, title and interest, if any, in the <br /> 16 subject real property as legally described on the attachment hereto to A. A. Wexler and <br /> 17 Gilda J.
