1 RESOLUTION NO. <br /> 2 <br /> A RESOLUTION requesting A. A. Wexler and Gilda J. Wexler to transfer <br /> 3 certain property to the City of Everett. <br /> 4 <br /> 5 <br /> WHEREAS, the City Council finds that an agreement (hereinafter referred to as <br /> 6 <br /> "Agreement") was executed in 1974 between the City and A. A. Wexler and Gilda J. <br /> Wexler (hereinafter collectively referred to as "Wexler") wherein Wexler agreed to <br /> 8 provide an alternate corridor between Fleming Road and Evergreen Way as well as a <br /> 9 certain amount of money to be applied towards the improvement of the corridor in <br /> 10 consideration of the City vacating Lake Street; and <br /> 11 WHEREAS, the City Council finds that at the time the Agreement was executed, <br /> 12 Wexler did not have all of the necessary property to complete the corridor and was, <br /> 13 therefore, provided a ten year time frame within which to acquire the necessary <br /> 14 <br /> property; and <br /> 15 WHEREAS, the City Council finds that the City did vacate Lake Street pursuant <br /> 16 to Ordinance No. 281-74; and <br /> 17 WHEREAS, the City Council finds that Wexler has now acquired the additional <br /> 18 property needed to complete the Fleming Road-Evergreen Way alternate corridor; <br /> 19 and <br /> 20 WHEREAS, the City Council finds that there is no present need for the <br /> 21 improvement of said corridor which would cost in excess of $50,000 and that Wexler <br /> 22 would like to retain title to the property within the corridor while making other <br /> 23 provisions for emergency access and pedestrian flow between Fleming Road and <br /> 24 Evergreen Way; and <br /> 25 WHEREAS, the City Council finds that the Agreement requires Wexler to <br /> 26 contribute a maximum of $6,000 plus 6% per annum towards the improvement of the <br /> 27 corridor "to the standards established by the City Engineer for City streets, including <br /> 28 curbs and gutters"; and <br /> 29 WHEREAS, the City Council finds that the Traffic Advisory Committee <br /> 30 reviewed this issue on July 12, 1983, and recommended that the City obtain from <br /> 31 Wexler the property which was the subject of the Agreement and, if possible, utilize <br /> 32 <br />
