OR <br /> RIGHT-OF-ENTRY AGREEMENT <br /> for Snohomish County <br /> REAL ESTATE MANAGER PROJECT: COE-Transmission Line#5 at Pilchuck River <br /> 3200 CEDAR STREET SITE ADDRESS: Pilchuck River near Three Lakes Road <br /> EVERETT,WA 98201 <br /> • <br /> • <br /> rN <br /> This agreement made this day of Arz i L , 2015, by and between the City of Everett, <br /> (hereinafter referred to as "Grantor") hereby grants permission to Snohomish County, <br /> (hereinafter referred to as"Grantee"), to enter upon certain lands in donation of mutual benefits <br /> for the proposes of allowing county staff access for the following: <br /> Inspection of restoration planting as required under Snohomish County Permits <br /> #11108651-SHOR and#15101919-LDA. <br /> The property to which this right-of-entry agreement applies is that portion of City owned <br /> property generally known as Snohomish County Assessor's Tax Parcel#28060500300600 and as <br /> more specifically depicted on Exhibit A attached hereto and incorporated herein by reference. <br /> The Grantor and Grantee, by granting and accepting this right-of-entry agreement respectively, <br /> mutually covenant and agree as follows: <br /> . 1. The Grantee and or its authorized agents or subcontractors will make reasonable efforts to <br /> minimize disruption and inconvenience to said property and uses made thereof. <br /> • <br /> 2. This right of entry agreement shall terminate on December 31,2020,or until the performance <br /> standards are achieved as specified per the permit conditions. • <br /> 3. Except as otherwise provided in this paragraph, the Grantee hereby agrees to defend and <br /> indemnify the Grantor from any and all Claims arising out of,in connection with, or incident <br /> to any acts, errors, omissions, or conduct by Grantee (or its employees, agents, <br /> representatives subcontractors/subconsultants) relating to this Agreement. The Grantee is <br /> obligated to defend and indemnffy the Grantor pursuant to this paragraph whether a Claim is <br />
