2 <br /> (d) Transfer'Lot 3 -Acceptance Standards Work. Owner shall complete, <br /> in accordance with the Amended Permit, all work as shown in the approved plan set prepared by <br /> David Evans &Associates dated March, 2017 and in the Geotechnical Engineering Services <br /> report dated March,2017 attached as Exhibit C-1 (which shall replace and modify the <br /> requirements detailed on Exhibit C attached to the Development Agreement) (the"Transfer <br /> Lot 3 Minimum Work Approved Plans"). The Transfer Lot 3 Minimum Approved Plans state <br /> the minimum work that will be completed by Owner(with all work in the Transfer Lot 3 <br /> Minimum Work Approved Plans,being the"Transfer Lot 3 Minimum Acceptance Standards <br /> Work"). In addition to the Transfer Lot 3 Minimum Acceptance Standards Work, Owner shall <br /> have the right to raise the rough grade elevation of Transfer Lot 3 to the elevations shown in the <br /> approved plan set prepared by David Evans &Associates dated March,2017 and in the <br /> Geotechnical Engineering Services report dated March,2017 attached as Exhibit C-2 (to no <br /> greater than 542 feet maximum elevation[NAVD of 1988 Datum],plus or minus 1.0 feet) (such <br /> grade raising,in addition to all other work contained in such Exhibit C-2,the"Transfer Lot 3 <br /> Maximum Work"). Upon completion of the Transfer Lot 3 Minimum Acceptance Standards <br /> Work, Owner may notify City of completion of the Transfer Lot 3 Minimum Acceptance <br /> Standards Work(a"Completion Notice"). Such Completion Notice shall state whether Owner <br /> intends to complete the Transfer Lot 3 Maximum Work, or intends to convey Transfer Lot 3 to <br /> the City, as provided in Section 1.4 below. If such Completion Notice states that Owner intends <br /> to complete the Transfer Lot 3 Maximum Work,then Owner shall provide a Completion Notice <br /> upon completion of such work,which shall trigger another Inspection Period under Section 1.4. <br /> For clarity,the parties confirm that the only acceptable work is either the (1)Transfer Lot 3 <br /> Minimum Acceptance Standards Work or(2)Transfer Lot 3 Minimum Acceptance Standards <br /> 6 <br /> 131047136.14 <br /> 13 <br />
