1 RESOLUTION NO. 0.2/ <br /> 2 A RESOLUTION urging State and Federal legislation to prohibit sale, <br /> 3 distribution, possession and use of explosive fireworks. <br /> 4 <br /> 5 WHEREAS, Chapter 230, 1982 Laws of Washington, eliminated the "safe and <br /> sane" fireworks laws and amended the Washington state-wide fireworks laws to allow <br /> 6 the general public to purchase, possess and use "common fireworks" (explosive-type <br /> 7 fireworks containing less than 50 mg explosive substance or 130 mg if aerial (Class C <br /> 8 explosives under U. S. Dept. of Transportation)) during the Fourth of July celebration; <br /> and <br /> 9 WHEREAS, the City Council of the City of Everett finds that the 1982 Fourth of <br /> 10 July celebration in our City was blemished by indiscriminate use of explosive-type <br /> 11 fireworks, both of "common fireworks" and other explosive fireworks of greater than <br /> 50 mg of explosive substance originating from sources outside the City of Everett, <br /> 12 which disturbed the peace of our neighborhoods and endangered citizens at parades and <br /> 13 other public gatherings where fireworks were set off by children and adults who were <br /> untrained, inexperienced and careless in the use of the explosive-type fireworks now <br /> 14 <br /> legally available; and <br /> 15 WHEREAS, the City Council further finds that a return to non-explosive "safe <br /> 16 and sane" fireworks would be in the best interest of the safety and welfare of our City <br /> but that the City is not legally entitled to regulate explosive fireworks in conflict with <br /> 17 <br /> Chapter 230, 1982 Laws of Washington; <br /> 18 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> 19 OF EVERETT: <br /> 1. That the City urges the Washington State Legislature to repeal the <br /> 20 <br /> current law which allows explosive fireworks to be sold and used by the general public, <br /> 21 and further urges State and Federal legislative bodies to establish regulations which will <br /> 22 effectively prohibit in this State and elsewhere the sale and use of explosive fireworks <br /> except for public displays supervised by licensed operators with appropriate pyrotechnic <br /> 23 skills and experience. <br /> 24 � <br /> 254 >« 1 <br /> Councilman Introd 1 'g ` esoluti. <br /> 26 <br /> 27 PASSED and APPROVED this Jg day of (G r , 1982. <br /> 28 ���- <br /> 29 Council President <br /> 30 <br /> 31 <br /> 32 <br />
