1 RESOLUTION NO. a /,5-8 <br /> 2 A RESOLUTION designating Newell Smith as Hearing Examiner for <br /> 3 purposes of vehicle abatement proceedings pursuant to Ordinance <br /> No. 869-82. <br /> 4 <br /> 5 WHEREAS, City Council finds that Ordinance No. 869-82 was adopted providing <br /> 6 for the removal of wrecked, dismantled, or inoperative vehicles or automobile hulks <br /> 7 from private property; and <br /> 8 WHEREAS, City Council finds that, according to the terms of the Ordinance, the <br /> 9 registered owner of the vehicle or the property owner where the vehicle in question is <br /> 10 located may request a hearing; and <br /> 11 WHEREAS, City Council finds that the hearing may be either before City <br /> 12 Council or hearing examiner appointed by City Council; and <br /> 13 WHEREAS, City Council finds that these hearings should be held before a <br /> 14 hearing examiner; and <br /> 15 WHEREAS, City Council finds that Newell Smith, attorney at law, presently sits <br /> 16 as hearing examiner for the City in parking hearings and vehicle forfeiture hearings; <br /> 17 and <br /> 18 WHEREAS, City Council finds that it would be appropriate to designate <br /> 19 Newell Smith as hearing examiner for these hearings also. <br /> 20 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> 21 OF EVERETT, that Newell Smith is hereby appointed to act as hearing examiner for <br /> 22 purposes of vehicle abatement proceedings pursuant to Ordinance No. 869-82. <br /> 23 <br /> ; <br /> 24 /, ���� <br /> Councilman Introducifig R lution <br /> 25 <br /> 26 PASSED and APPROVED this RS-14-4—day of August, 1982. <br /> 28 Council President <br /> 29 <br /> 30 <br /> 31 <br /> 32 <br />
