ORDINANCE 3557-17 <br /> AN ORDINANCE granting permission to maintain and operate an overhead covered <br /> walkway across Wetmore Avenue, between Blocks 666 and 667, Plat of Everett, Snohomish <br /> County, Washington, approximately sixteen(16) feet south of California Street; and specifying <br /> the conditions under which this permission is granted. <br /> WHEREAS, <br /> A. In 1966, the Everett City Council by Ordinance No. 4146 granted to Alstore's <br /> Realty Company the right to construct, maintain, and operate an overhead covered walkway <br /> (the "Covered Walkway") across Wetmore Avenue between Blocks 666 and 667, Plat of <br /> Everett, Snohomish County, Washington, approximately sixteen(16) feet south of California <br /> Street. <br /> B. The rights granted under Ordinance No. 4146 were for 50 years and have expired. <br /> Ordinance No. 4146 provides that the permissions thereunder may be renewed. <br /> C. The current owner, Port Gardner Building, LLC ("Grantee" or"PGB") desires to <br /> the renew the permissions to operate and maintain the Covered Walkway. <br /> D. The City agrees to renew such permissions and to again grant the right to operate <br /> and maintain the Covered Walkway, all as under set forth in this Ordinance. <br /> NOW,THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Permissions—Administration— <br /> A. Covered Walkway. Subject to the terms and conditions of this Ordinance, <br /> the City hereby grants permission to PGB to maintain and operate an enclosed Covered <br /> Walkway over and across Wetmore Avenue between Blocks 666 and 667, Plat of Everett, <br /> Snohomish County, Washington, approximately sixteen (16) feet south of California Street, for <br /> the purpose of facilitating pedestrian travel. <br /> 1 <br />
