CITY OF EVERETT SPECIAL PROVISIONS I DIVISION P - PROPOSAL CITY OF EVERETT,WASHINGTON I SEWER REGULATORS R4 AND R39 MODIFICATIONS WORK ORDER# UP3633 1 To the City Council Everett,Washington I The undersigned Bidder declares that he has carefully examined the Plans and Specifications, INotice to Contractors, Standard Specifications, Special Provisions, Appendix, Proposal, and Contract for the construction of approximately 200 linear feet of 6-inch water main, and approximately 90 linear feet of combined sewer main up to 48-inch diameter,modifications to an I existing combined sewer regulator R39,construction of a new combined sewer regulator R4, and other such appurtenances and performing all Work as required by the Contract, in accordance with the Contract Plans and Contract Provisions.. The undersigned declares that he has made such investigations as are necessary to determine the conditions to be encountered, and that, if Ithis Proposal is accepted, he will enter into a contract with the City of Everett, Washington, in the form of Contract hereto annexed, he will, to the extent required, provide the necessary equipment, tools, apparatus, and other means of construction, and he will furnish all labor and I materials necessary to complete the Work in the manner herein specified and according to the requirements of the Engineer. The undersigned Bidder certifies that this Proposal is in all respects fair and is made without I collusion on the part of any person, firm or corporation mentioned below, and no officer or employee of the City of Everett is personally or financially interested, directly or indirectly, in the Proposal or in any purchase of or sale of any materials or supplies for the Work to which it Irelates, or any portion of the profits thereof. The undersigned Bidder agrees that he will complete the Work in all respects as required by Division C, Article 2. Time for Completion and that he will pay liquidated damages to the ICity in the amount specified in the Contract. Accompanying this Proposal is a bid bond or certified check in the amount of five percent (5%) I of the Proposal according to the conditions of the "Notice to Contractors" and "Division 1 - General Requirements" hereby attached. If this Proposal shall be accepted by the City of Everett, Washington, and the undersigned shall fail to execute a satisfactory contract and bond, as stated in the Division 1 —General Requirements hereto attached, within 14 calendar days after I the Award Date, then the City may, at its option, determine that the undersigned has abandoned the Contract and thereupon this Contract shall be null and void and the amount of the bid bond or certified check accompanying this Proposal shall be forfeited and become the property of the I City of Everett,Washington.
