October 9,2007 shows that as of that date the slab had not been poured for the wall. See <br /> Exhibit 3. <br /> 4. On October 10, 2007, City inspector,Randy Allen, issued a stop work notice based on <br /> his assessment of the partially constructed wall and Mr. Popov's failure to adhere to the <br /> design as submitted by Mitchell Engineering. See Exhibit 4. The stop work notice was in <br /> writing and was posted on Mr. Popov's property. The notice ordered the owner to stop the <br /> pouring of any concrete foundations or slabs. <br /> 5. That same day,the Permit Services Manager discovered that the owner had disregarded <br /> the October 10,2007 stop work notice by causing the slab to be poured. See Exhibit 5 <br /> (photos of the wall and poured slab). The slab covers the deficiencies in the construction of <br /> the footing,making it more difficult to identify and correct the problems in the <br /> construction. <br /> 6. On October 10, 2007, the Permit Services Manager wrote a letter to Mr. Popov <br /> regarding the basement retaining wall,noting that no final inspections would be conducted <br /> until Mr.Popov submitted two sets of drawings from an engineer of record that accurately <br /> represents the wall as built and provides a letter that the wall as built complies with <br /> construction codes. The letter concluded that Mr. Popov must demolish and reconstruct the <br /> wall under the established permit process or correct the deficiencies related to the wall. See <br /> Exhibit 6. <br /> 7. On November 16, 2007, the Permit Services manager issued a second stop work notice, <br /> noting that the retaining wall had been constructed incorrectly and without inspections. <br /> The stop work notice ordered that there be no use of the [attached] carport. See Exhibit 7. <br /> 8. At no time has the retaining wall attached to the south side of the building at 4841 <br /> Glenwood Avenue been consistent with any engineering plan submitted by the owner or <br /> the owner's engineer. <br /> 9. At no time has the City received a letter from an engineer of record for that retaining <br /> wall that the wall, as built, complies with codes and addresses drainage issues for the <br /> building. <br /> B. Ecology Block Retaining Wall lying along a private driveway off Glenwood <br /> Avenue, serving properties at 4837 Glenwood Avenue,4839 Glenwood Avenue, and <br /> 4841 Glenwood Avenue <br /> 1. On October 27, 2005, Peter Popov took title to the property at 4841 Glenwood Avenue <br /> from grantor,Dynasty Homes,Inc. See Exhibit 8. <br /> 2. Peter Popov is a married man but owns the property as his separate estate. Dina Popov, <br /> his spouse, granted Mr. Popov whatever interest she had in the property on October 27, <br /> 2005 through a quit claim deed. See Exhibit 8 above. <br />
