temporary sump pump to control storm water runoff. See Exhibit 13. Mr. Allen's June 13, <br /> 2007 inspection report also notes that he observed the wall to be over eight feet in height. <br /> 13. Each ecology block represents approximately two feet in height.Five rows of ecology <br /> blocks stacked on top of one another would be eight to ten feet in height. <br /> 14. On July 26,2007,Mr. Allen,notified Mr. Popov and the owners of 4839 and 4837 <br /> Glenwood that the City requires that the owners retain a geotech or structural engineer of <br /> record and obtain from the engineer of record a special inspection, written approval and <br /> final certification for the wall. See Exhibit 14. <br /> 15. Mr. Popov's engineer from Mitchell Engineering, submitted an engineering detail for <br /> the ecology block retaining wall in fall 2007. See Exhibit 15.That engineering detail <br /> indicated that the wall should have been constructed to provide the following: a physical <br /> drain as well as drain rocks interspersing the layers of backfill to accommodate the <br /> potential subsurface runoff. That engineering detail,however, appeared to be intended to <br /> address the potential build-up of pressure from the additional dirt and water at the back of a <br /> wall that is made up of four,not five,rows of ecology blocks stacked on top of each other. <br /> 16. The Mitchell Engineering detail also failed to comprehensively address drainage and <br /> erosion issues. <br /> 17. On October 1,2007, the Building Official contacted Mitchell Engineering to notify <br /> Michael Mitchell that the ecology block retaining wall had been constructed five-block(or <br /> ten feet)tall. The engineer stated that per his detail,the wall should be only four blocks <br /> tall. See Exhibit 15 (note at bottom). <br /> 18. At no time did Mr. Popov or Mitchell Engineering submit any documentation of <br /> inspections performed by an engineer of record or a certification from an engineer of <br /> record. <br /> 19. On November 16, 2007, a portion of the retaining wall lying along Mr. Popov's <br /> property at 4841 Glenwood Avenue collapsed. Blocks of the retaining wall tumbled onto <br /> adjacent property,lying at the toe of slope running down from the ecology block retaining <br /> wall. See photos at Exhibit 16. <br /> 20. Additionally,the owners of adjacent property have indicated that they have observed <br /> excess drainage across property lines from Mr. Popov's property to theirs. The adjacent <br /> properties have experienced flooding and erosion of the ground in areas where water <br /> flowing from Mr. Popov's property has discharged. <br /> 21. On November 29, 2007, the building official wrote a letter to Mr. Popov noting the <br /> partial collapse of the portion of retaining wall lying along 4841 Glenwood Avenue. In that <br /> letter, the Building Official outlined the City's requirement for action by the owner. These <br /> actions included: 1) the retention of a licensed engineer to act as the engineer of record for <br /> the retaining wall; 2)the preparation of a design for the repair of the wall that is not only <br />
