RESOLUTION NO. Z/.8 7 <br /> A RESOLUTION amending the <br /> Comprehensive Plan of the City of <br /> Everett as provided for by Everett <br /> Municipal Code Title 2, Section 20, <br /> Subsection 120, to encompass an <br /> area in the vicinity of 107th Street <br /> S.E. and 3rd Avenue S.E. <br /> WHEREAS, the City Council finds that on April 20, 1982, the Planning <br /> Commission held a public hearing regarding establishing the Comprehensive Plan <br /> designation for the hereinafter described property; and <br /> WHEREAS, the City Council finds, after reviewing the Planning Commission <br /> recommendation at public hearings on June 2, 1982, and July 14, 1982, as required <br /> by R.C.W. 35.13.170, that Medium Density Residential land uses with an open space <br /> corridor along North Creek are compatible with the surrounding community; and <br /> WHEREAS, the City Council finds that a Notice of Intention to Annex to the <br /> City of Everett for the property is pending before the Snohomish County Boundary <br /> Review Board; and <br /> WHEREAS, the City Council finds that State Law requires that a <br /> Comprehensive Plan land use designation be established for areas annexed to the <br /> City; and <br /> WHEREAS, the City Council finds that Comprehensive Plan designations <br /> hereinafter set forth are in the best interests of the City of Everett. <br /> NOW, THEREFORE, be it resolved that: <br /> 1. The Comprehensive Plan designations of Medium Density Residential, 5-10 <br /> Dwelling Units Per Gross Acre with an Open Space corridor along North <br /> Creek as shown on the attached map, Exhibit A, are hereby adopted for the <br /> following described property: See Exhibit B. <br /> 2. The Official Map in the Planning Department of the City of Everett shall <br /> upon passage of this Resolution and annexation of the property to the City of <br /> Everett, be amended as hereinabove provided. <br /> 3. The Everett Community Plan policies for Sector F8 shall apply to the <br /> hereinabove described property. <br /> 4. The day care center located at 10814 7th Avenue Southeast shall be <br /> permitted to operate subject to the conditions contained in Snohomish County <br /> Conditional Use Permit No. 82-72, filed under City of Everett Special <br /> Property Use Permit No. 2-82. Upon annexation, the Staff shall initiate a <br /> review of the operation of the day care center for compliance with the <br /> aforementioned conditions. <br /> Councilman Int •d in' 'esol,.fl•n <br /> Passed and Approved this /"7‘ day of „IC; , 1982. <br />
