• <br /> RECISION OF AGREEMENT <br /> This Agreement entered into by and between Goedecke Development, Inc., a <br /> Washington corporation, and hereinafter referred to as "Developer," and the City <br /> of Everett, a municipal corporation hereinafter referred to as "City." <br /> WHEREAS, on November 26, 1979, the Developer and City entered into an <br /> agreement requiring the establishment of a fee in lieu of park land dedication, a <br /> copy of which is attached to this agreement and incorporated herein by reference; <br /> and <br /> WHEREAS, said agreement of November 26, 1979, required that said fee be <br /> set within six (6) months of the execution of the agreement; and <br /> WHEREAS, no fee was ever established by the Everett City Council; and <br /> WHEREAS, on June 9, 1982, the Everett City Council authorized the Mayor <br /> of the City of Everett to rescind the agreement dated November 26, 1979; and <br /> NOW, THEREFORE, it is hereby agreed between the Developer and City as <br /> follows: <br /> I <br /> 1. The parties hereby agree to rescind the agreement between <br /> the Developer and the City dated November 26, 1979. <br /> 2. This agreement may be filed in the office of the Snohomish <br /> County Auditor as evidence of the release and extinguishment <br /> any lien or encumbrance that may have attached to <br /> Developer's property as a result of the execution of the <br /> agreement dated November 26, 1979. <br /> 3. Developer further agrees to hold the City harmless from any <br /> claims, expenses, cause of action, including attorneys' fees <br /> that are caused as a result of the execution of the agreement <br /> dated November 26, 1979. <br /> IN WITNESS WHEREOF, we have executed this agreement on the 7nel <br /> day of 1982. <br /> CITY OF EVERETT GOEDECKE <br /> DEVELOPMENT 20:-; <br /> INC. <br /> MAYOR PRESIDENT <br /> ATTEST: <br /> I <br /> Its ' <br /> CITY CLERK <br /> APPROVED AS TO FORM: <br /> L`'IT ATTORNEY <br />
