1 RESOLUTION NO. o 3' 0 <br /> 2 A RESOLUTION authorizing the City Attorney's Office to execute a <br /> Settlement Agreement. <br /> 3 <br /> 4 WHEREAS, the City Council finds that the City of Everett is a party to a Quiet <br /> 5 Title action, No. 80-2-01838-6, instituted by Marvin and Clariece Tobler in which there <br /> 6 is a dispute as to the ownership of a parcel of property; and <br /> 7 WHEREAS, the City Council finds that the property in question is an unimproved <br /> 8 alley located directly to the east of the 6500 block of Broadway in Everett which alley <br /> 9 is legally described as follows: <br /> 10 <br /> East 8 feet of Lot 9, Block 14, Plat of Pinehurst as per plat recorded in <br /> 11 Volume 8 of Plats, page 3, records of Snohomish County, Washington, <br /> 12 <br /> and <br /> 13 <br /> WHEREAS, the City Council finds that the City of Everett never has had any <br /> 14 <br /> ownership interest in the above-described property nor has said property been deeded to <br /> 15 <br /> the City and/or accepted by the City; and <br /> 16 <br /> WHEREAS, the City Council finds that the property in question concerns a <br /> 17 <br /> private alleyway over which the City has no interest; and <br /> 18 <br /> WHEREAS, the City Council finds that the parties to the lawsuit have satis- <br /> 19 <br /> factorily resolved the issue of ownership so that the alley remains a private alleyway <br /> 20 <br /> serving the abutting properties and the City has been asked to sign a Settlement <br /> 21 <br /> Agreement to that affect; <br /> 22 <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EVERETT DOES <br /> 23 <br /> RESOLVE that the City Attorney's Office is authorized to execute a Settlement <br /> 24 <br /> Agreement on behalf of the City with the parties to this action whereby the property in <br /> 25 <br /> question remains a private alleyway. <br /> 26 <br /> 27 ittc,6_,E1-c6-L <br /> 28 Councilman Introducing Resolution <br /> 29 PASSED and APPROVED this /did-- day of April, 1982. <br /> 30 <br /> — <br /> 31 Council Presi.ent <br /> 32 <br />
