On March 2, 2016, Marcy Staats, City of Everett Utility Department, informed Officer <br /> Keirsey that water service to the residential structure on the property was locked. <br /> Tracy Tucek, Public Utility District of Snohomish County (PUD) informed Officer <br /> Keirsey that electrical service for the residential structure had been shut off on <br /> December 7, 2015. On March 4, 2016, the City issued a violation citation to the Respondents for <br /> violations of International Property Maintenance Code (IPMC) 108.1.3 Structure <br /> Unfit for Human Occupancy as adopted by EMC 16.005.010; IPMC 106.1 Unlawful <br /> Structure as adopted by EMC 16.005.010; IPMC 308.1 Accumulation of Rubbish <br /> and Garbage as adopted by EMC 16.005.010; IPMC 308.2 Disposal of Rubbish as <br /> adopted by EMC 16.005.010; Everett Municipal Code (EMC) 8.20.020(A)(C)(G) <br /> Nuisances and EMC 8.22.030(A) Inoperable Vehicles. Copies were mailed to the <br /> Respondents via first class and certified mail to the Respondents last known <br /> address which Officer Keirsey obtained from Snohomish County Assessors Record. <br /> A copy was posted at the property. Respondents Clark and Fowler were present at <br /> the time of posting. Each method of service used is independently sufficient to <br /> provide notice. (Pursuant to EMC 1.20.010.C.1) (Exhibit#4, Violation Citation dated <br /> March 4, 2016 with unclaimed mail receipts) (Exhibit#5, Declaration of Service <br /> dated March 4, 2016 with photos)(Testimony of Code Enforcement Officer Keirsey) <br /> 6. On March 4, 2016, Officer Keirsey posted the property with a condemnation placard <br /> that was issued because of the lack of approved water and electrical service. This <br /> deficiency rendered the residential structure unfit for human habitation. A notice of <br /> condemnation was mailed to the Respondents via first class mail and certified mail. <br /> The notice informed the Respondents of the violations present on the property and <br /> set forth that the entire structure be vacated no later than March 7, 2016 at 12:00 <br /> noon. (Exhibit#10, Notice of Condemnation dated March 4, 2016 with unclaimed <br /> mail receipts) (Exhibit#11, Condemnation Placard dated March 7, 2016) <br /> (Testimony of Code Enforcement Officer Keirsey) <br /> 7. On March 7, 2016, Officer Keirsey reinspected the property and observed and <br /> photographed that the residential structure remained occupied and conditions were <br /> the same as observed on March 1, 2016. While Officer Keirsey was on site, <br /> Respondent Clark left the property. Two Everett Police Officers arrived on site to <br /> ensure that Respondent Fowler and four other adults left the property.
