U <br /> 7 <br /> 4. Uncontained bagged trash on the property is a violation of IPMC 308.1 and IPMC <br /> 308.2. The Respondents violated said City ordinances. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondents are in default and were in violation of IPMC 106.1, <br /> IPMC 308.1, IPMC 308.2, EMG 8.20.020(A)(C)(G) and EMC 8.22.030(A) and are <br /> hereby ordered to: <br /> 1. The Respondents must abate all violations of IPMC 106.1, IPMC 308.1, IPMC <br /> 308.2, EMC 8.20.020(A)(C)(G) and EMC 8.22.030(A) on property located at 1510 <br /> Walnut Street, Everett, Washington. <br /> 2. Abatement of the violations on said property must be completed by April 22, 2016. <br /> The cleanup and abatement shall include: <br /> a. The Respondents shall remove or properly store all discarded items visible on <br /> the property. <br /> b. The Respondents shall maintain the property free of nuisances including <br /> discarded bagged garbage, boxes, litter, household equipment, furniture, <br /> salvage material and personal items. Approved garbage containers with tight <br /> fitting lids shall be used to store garbage and refuse on the property. <br /> c. The Respondents shall maintain approved water and electrical service to the <br /> residential structure or the structure shall be vacated immediately and shall <br /> remain unoccupied until the utilities are restored. <br /> d. The Respondents shall properly and legally license all vehicles parked on the <br /> property, or cover the vehicles with approved car covers. <br /> 3. All the Respondents are fined $2000.00 for violations of IPMC 106.1, IPMC 308.1, <br /> IPMC 308.2, EMC 8.20.020(A)(C)(G) and EMG 8.22.030(A). The Respondent <br /> Estate shall also be fined $500.00 for violation of EMC 8.22.030(A). <br /> 4. The Respondents shall not violate any ordinance set forth in EMC §1.20.020 or any <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br /> for the next twenty-four (24) months. <br /> 5. All the Respondents shall pay the$2500.00 fine no later than April 29, 2016. <br /> Payment shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100, <br /> Everett Washington, 98201. If payment is not made on or before April 29, 2016 <br /> collection action will be taken, which may include assigning the debt to a collection <br /> agency pursuant to EMC §1.20.050(0). <br /> 190 <br />
