• CITY OF EVERETT, WASHINGTON • Ir RESOLUTION NO. aacz A RESOLUTION of the City Council of the City of Everett, Washington, declaring its intention to order the improvement of Everett Mall Way Southeast (formerly South Broadway) at its intersection with Primary State Highway No. 1 (SR .5) (Interstate 5) and to create a local improvement district to assess the cost and expense of carrying out such improvement against the properties specially benefited thereby, and notifying all persons who desire to object to the improvements to appear and present their objections at a meeting of the City Council to be held on January 27, 1982. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT, WASHINGTON, as follows: Section 1. A petition has been received to create a local improvement district to construct and install a certain improvement within the City, signed by a majority of the property owners of the area of property within the proposed district, and the City Council finds that the petition is sufficient under the law. Section 2. It is the intention of the City Council of the City of Everett, Washington, based on such petition, to order the improvement of the following property: That portion of the Southeast Quarter of Section 18 Township 28 North, Range 5 East WM lying East of the Public Utility District Number 1 right-of-way (formerly Northwest Traction Company North-South right-of-way); West of Primary State Highway Number 1, (also known as Interstate 5); and North of the following described line: Beginning at the intersection of the West line of said Primary State Highway Number 1 and the South Line of said Section 18; thence West along the South Section Line of said Section 18 to a point which is 651.75 feet East of the center of said Section 18; thence N 02°15'00" W a distance of 244.22 feet; thence N 66°05'59" E a distance of 174.55 feet; thence N 02°15'00" W to a point 1090.61 feet South of Everett Mall Way (formerly South Broadway, formerly Diagonal Way); thence S 87°45'00" W a distance of 465.50 feet more or less to intersect said Public Utility District Number 1 right-of-way and the terminus of this description, except the West 11.50 feet lying South of said Everett Mall Way. by the construction and installation of a traffic signal system at Everett Mall Way Southeast (formerly South Broadway) at its intersection with Primary State Highway No. 1 (SR 5) (Interstate 5) southbound off-ramp. Section 3. The total estimated cost and expense of the improvement is declared to be $100,180 and the entire cost and expense of such improvement shall be borne by and assessed against the property specially benefited by such improvement to be included in a local improvement district to be established embracing as near as may be all property specially benefited by such improvement, except that Washington State Department of Transportation shall provide the traffic signal controller and the City of Everett half cent gas tax fund Number 301 shall contribute one-half of the remaining cost.
