5.3 Presence of Legal Counsel at Public Hearings or Meetings <br /> a. All parties participating in the hearings will be allowed <br /> to be represented at the hearings by legal counsel of <br /> their choice. Representation by legal counsel is not <br /> required at the hearings. <br /> b. At the request and discretion of the Hearing Examiner, a <br /> representative of the City Attorney's Office may be <br /> present at the public hearings or meetings to advise on <br /> matters of law and procedure. <br /> VI. CONDUCT OF HEARINGS <br /> 6.1 Content of the Record <br /> The record of a hearing conducted by the Hearing Examiner <br /> may include, but not be limited to, the following materials: <br /> a. The application or petition; <br /> b. The departmental staff reports; <br /> c. All evidence received or considered, which shall include <br /> all exhibits and other materials filed; <br /> d. A statement of all matters officially noticed; <br /> e. A decision or a recommended decision containing the <br /> findings and conclusions of the Hearing Examiner; <br /> f. Recordings made on electronic equipment; and <br /> g. An environmental determination made pursuant to the <br /> State Environmental Policy Act of 1971 (SEPA) and <br /> Ordinance Number 582-79 of the City of Everett. <br /> 6.2 Development of Record <br /> A public hearing shall include, but not be limited to, the <br /> following elements: a brief introductory statement by the <br /> Examiner; a report by the departmental staff which shall <br /> include introduction of the official file, reference to visual <br /> aids (maps), and a summary of the recommendation of the <br /> Department; testimony by the applicant or petitioner; <br /> testimony in support of the application; testimony in <br /> opposition to the application; opportunity for cross- <br /> examination and rebuttal; and opportunity for questions by the <br /> Hearing Examiner. <br /> 6.3 Legal Counsel <br /> Parties will be allowed to be represented by legal counsel at <br /> all stages of the hearings. <br /> 6.4 Content and Form of Staff Reports • <br /> The staff report may include any of the following items; <br /> provided that when the Hearing Examiner specifically requests <br /> that certain items be included in the staff report those items <br /> shall be included in said report. <br /> a. The names and addresses of the owner(s) and applicant(s) <br /> of the subject property. <br /> b. A brief summary of the requested action. <br /> c. A common description of the subject property and a legal <br /> description of the subject property. <br /> d. A technical data summary of the Comprehensive Plan <br /> designations and zoning designations of the subject <br /> property; the current developments of the subject <br /> property and the. adjoining properties; topographical <br /> information; geological and soils information; and <br /> information relative to the vegetation on the property. <br /> -4- 5/81 <br />
