I <br /> RESOLUTION NO. P/c/ <br /> IN THE MATTER OF SR 2, Fobes Hill to <br /> Westwick Road <br /> WHEREAS, the CITY OF EVERETT is the holder of certain easement rights <br /> lying within the above-designated project constructed or to be constructed by the <br /> State of Washington, Department of Transportation; and <br /> WHEREAS, in the improvement of said above-designated highway by the State <br /> of Washington, Department of Transportation, it is necessary and advisable for the <br /> State of Washington to obtain an AGREEMENT AND QUIT CLAIM DEED as hereto <br /> attached as Exhibit "A" for the purpose of clearing the right-of-way in accordance <br /> with the laws of the State of Washington; and <br /> WHEREAS, after due consideration by the Mayor and Council of the said CITY <br /> OF EVERETT, it appears to said Mayor and Council that it will be in the best <br /> interest of the CITY OF EVERETT and the State of Washington that said CITY shall <br /> execute said AGREEMENT AND QUIT CLAIM DEED for a consideration of the <br /> covenants and conditions set out in said instrument and in further consideration of <br /> mutual benefits and other valuable consideration; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF EVERETT THAT: <br /> Section 1: The said CITY OF EVERETT, through its Mayor and City Clerk <br /> shall execute said AGREEMENT AND QUIT CLAIM DEED and deliver said <br /> instrument to the State of Washington, Department of Transportation. <br /> Councilman Introducing Res tion <br /> sr <br /> Passed and approved this,;,?/day of nAl• ',Ay , 1' :1. <br /> 4 <br /> . i. / <br /> o cil Prcsi• -nt <br />
