1 mattresses and a sofa, and other similar items still litter the exterior of the Property.18 Yost has 2 made no progress on the house. She has not obtained any permits to begin to correct the previously 3 made unlawful alterations. The house is falling apart,with parts of gutters hanging(not secured), 4 the unpermitted back porch rotting, a railing from the unpermitted upper deck hanging from a post, 5 and a significant portion of the house remains fire damaged(see subsection D,below for more 6 about the fire).19 After the fire the City's Code Official ordered Yost to board the property to 7 secure it from unlawful entry.20 Yost did not board the Property and so the City did it at her 8 expense. Yost has done nothing to protect the house from further deterioration. She has not taken 9 10 steps to repair the damaged and deteriorating exterior of the house. 11 C. Drug Nuisance 12 On top of the typical nuisance conditions plaguing the Property, in 2011 the City brought a 13 drug nuisance lawsuit against Yost to abate and prevent ongoing drug activity at the Property. For 14 at least a year and a half prior to the lawsuit, drug activity at the Property produced frequent police 15 calls, arrests, and loitering, causing increased concerns for safety and other adverse impacts on 16 surrounding neighborhood. This Court issued a preliminary injunction vacating and closing the 17 18 Property. Pursuant to the injunction the Property was vacated as of December 20,2011,and 19 remained vacated and closed for almost two years.21 The Court, at the parties' request, dissolved 20 the injunction on November 13,2013.22 21 D.
