1 mattresses and a sofa, and other similar items still litter the exterior of the Property.18 Yost has <br /> 2 made no progress on the house. She has not obtained any permits to begin to correct the previously <br /> 3 made unlawful alterations. The house is falling apart,with parts of gutters hanging(not secured), <br /> 4 the unpermitted back porch rotting, a railing from the unpermitted upper deck hanging from a post, <br /> 5 and a significant portion of the house remains fire damaged(see subsection D,below for more <br /> 6 about the fire).19 After the fire the City's Code Official ordered Yost to board the property to <br /> 7 <br /> secure it from unlawful entry.20 Yost did not board the Property and so the City did it at her <br /> 8 <br /> expense. Yost has done nothing to protect the house from further deterioration. She has not taken <br /> 9 <br /> 10 steps to repair the damaged and deteriorating exterior of the house. <br /> 11 C. Drug Nuisance <br /> 12 On top of the typical nuisance conditions plaguing the Property, in 2011 the City brought a <br /> 13 drug nuisance lawsuit against Yost to abate and prevent ongoing drug activity at the Property. For <br /> 14 at least a year and a half prior to the lawsuit, drug activity at the Property produced frequent police <br /> 15 <br /> calls, arrests, and loitering, causing increased concerns for safety and other adverse impacts on <br /> 16 <br /> surrounding neighborhood. This Court issued a preliminary injunction vacating and closing the <br /> 17 <br /> 18 Property. Pursuant to the injunction the Property was vacated as of December 20,2011,and <br /> 19 remained vacated and closed for almost two years.21 The Court, at the parties' request, dissolved <br /> 20 the injunction on November 13,2013.22 <br /> 21 D.
