EASEMENT <br /> The easement is over and across a tract of land situated in the Counry of Snohomish, State of <br /> Nashington, and the easeme�t is described as follows: <br /> See Exhibit "A" attached hereto and incorporated herein by rcference. <br /> This easement is granted subJect to and conditioned upon the following terms, conditions and <br /> covenants: <br /> 1. Grantor shall at ali times conduct its acdvities and all other activities conduc•ed on <br /> Grantor's property so as not to incerfero with, obswct or endanger the usefulness ` any <br /> improvements, or other facilities, now or hereafter maintained upon the easement, or in any <br /> way intertere with, obsuuct o�endanger the Ciry's use of the easement. <br /> 2. Prior to any conswction, work or any other activity by Grantor within the easement, <br /> nodfication and plans for the same shall be submitted in writing to the City by Grantor anr no <br /> such wr.iuuction, work or activity by Grantor shall be commenced without City's � .tor <br /> written agreement that the Grantor's proposed constiuction, work or activiry wi11 not interfere <br /> with t6e City's easement granted herein; PROVIDED, HOWEVER, any changes or revisions <br /> in the plans shall also be subject to City's prior agreement. The City's review of the Grantor's <br /> plans under this easement shall not be deemM to impose any duty or obligation on the City to <br /> deterntine the adequacy or su�ciency of Grantor's plans anci designs nor whether Grantor's <br /> conswction, work or activiry is ia conformance with o[her app(icabie plans, codes and <br /> regulations.
