EASEMENT <br /> 6. Grantor dces release, indemnify and promise to defend and save harniless the Ciry, <br /> its officers, employees and agents from and against any and all liability, loss, damage, <br /> expease, actions and claims, including costs and rcasonable attorney's fces incurred by the <br /> Ciry, its officers, employees and agents in defense thereof, asserting or arising directly or <br /> indirecdy on account of or out of Grantor's use or activity �vithin the above-described <br /> easement. This paragraph does not purport to i�emnify the Ciry against liabiliry for damages <br /> arising out of bodiiy inJury to �rsons or damages to property caused by or resulting from thc <br /> sole negligence of the Ciry, its officers, employees and agents; provided, that if the claims or <br /> damages are caused by or result from the concurnnt negligence of(a) the Grantor, its agenu, <br /> successors or assigns, and (b) the Ciry, its officers, employees or agents, this indemniry <br /> provision shall be valid and enforceable to the extent permitted by 1aw, The Grantor <br /> specIficallv azM expresslv waives anv immunitv under Industrial Insurance Tide SI RCW and <br /> acknowledrtes that this waiver has been mutuallv tuQodated bv the parties <br /> 7.
