2 <br /> ORDINANCE No. <br /> AN ORDINANCE Relating to Permitting Prostitution,Amending Section 2 of Ordinance <br /> No. 1567-89 (Chapter 10.24.130 EMC). <br /> Whereas,the Everett Municipal Court has recently ruled that the City ordinance <br /> prohibiting the crime Permitting Prostitution(Chapter 10.24.130 EMC)is, in part, <br /> unconstitutionally void for vagueness; and <br /> Whereas,the City of Everett has the power to provide for the punishment of all practices <br /> dangerous to public health or safety, and to make necessary for the preservation of public health, <br /> peace and good order and to provide for the punishment of all persons charged with violating any <br /> city ordinances; and <br /> Whereas,the Everett City Council deems it appropriate for the crime Permitting <br /> Prostitution (Chapter 10.24.130 EMC)to be amended in light of the Everett Municipal Court <br /> ruling; <br /> NOW,THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 2 of Ordinance No. 1567-89 (EMC 10.24.130),is hereby amended as <br /> follows: <br /> Permitting prostitution. <br /> 1. A person is guilty of permitting prostitution if, having possession or control of premises <br /> which he or she knows are being used for,prostitution purposes, he or she fails without <br /> lawful excuse to make reasonable effort to halt or abate such use. <br /> 2. Permitting prostitution is a misdemeanor. <br /> Be and the same is hereby amended to read as follows: <br /> Permitting prostitution. <br /> 1. A person is guilty of permitting prostitution if, having possession or control of premises <br /> which he or she knows are being used for prostitution purposes, he or she fails without <br /> lawful exe se to make reasonable effort to halt or abate such use. <br /> 2. Permitting prostitution is a misdemeanor. <br /> Section 2. Severability <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this Ordinance or its <br /> application to any person or situation,be declared unconstitutional or invalid for any reason, such <br /> decision shall not affect the validity of the remaining portions of this Ordinance or its application <br /> to any other person or situation.
