RESOLUTION NO. 1724 <br /> A RESOLUTION establishing the compensation <br /> of one-half the appraised value on street <br /> vacations, exceptions thereto, and providing <br /> a method of appraising streets to be vacated. <br /> WHEREAS, the City Council is authorized to vacate streets <br /> and alleys; and <br /> WHEREAS, RCW 35. 79 . 030 allows a city, in vacating a <br /> street or alley, to require compensation from abutting property <br /> owners which does not exceed one-half of the appraised value <br /> of such vacated area; and <br /> WHEREAS, the City Council desires to establish a uniform <br /> policy for the payment of compensation for street and alley <br /> vacations and to provide a method of appraising such streets <br /> and alleys to be vacated. <br /> NOW, THEREFORE, BE IT RESOLVED: <br /> Section 1 : Ordinances vacating any street or alley, or <br /> any part thereof, pursuant to the provisions of RCW Chapter 35 .79 <br /> shall provide that the same shall not become effective until <br /> the owners of property abutting upon the street or alley, or <br /> part thereof so vacated, shall pay to the City one-half the <br /> appraised value of the area so vacated. <br /> EXCEPT IN THE FOLLOWING CIRCUMSTANCES : <br /> A. An area equal to or greater than the area to be <br /> so vacated, shall be deeded to the City for street and utility <br /> purposes, at a location and alignment as designated and accepted <br /> by City Council, along with all improvements to make thereto in <br /> accordance with City of Everett' s policies, procedures, ordinances, <br /> codes and specifications as determined by the City Engineer. <br /> B. An area equal to or greater than the area to be <br /> vacated shall be developed as a "Green Belt" zone within <br /> specific areas of the City under certain types of zone classifi- <br /> cations as established and recommended by the Planning Department. <br /> The "Green Belt" must be beneficial to the needs of the City of <br /> Everett as approved by City Council and the surrounding neighbor- <br /> hood and all construction, installation, operation, and mainten- <br /> ance thereto shall be the full responsibility of the property <br /> owner (s) . <br /> C. The City of Everett and/or the State of Washington <br /> and/or the federal government shall have all compensations and <br /> fees waived. <br />
