4; <br /> arising from Lynch' construction and use of the Covered Walkway. The Director shall notify <br /> Lynch of the new requirements in writing. Lynch shall provide proof of compliance with such <br /> new requirements within sixty(60) days after receipt of such notice. <br /> Section 15. Consent for and Conditions of Assignment or Transfer. <br /> The right,privilege and authority granted under this Ordinance shall not be assignable or <br /> transferable by operation of law,nor shall Lynch transfer, assign, mortgage,pledge or encumber <br /> the same without the consent of the City,which consent the City shall not unreasonably refuse. <br /> In order for any assignment or transfer of Lynch' rights to be effective, Lynch and the assignee <br /> or transferee must file with the City Clerk(A) a Performance Bond and(B) an assignment and <br /> assumption agreement in a form acceptable to the City under which the assignee or transferee <br /> assumes all of Lynch obligations under this Ordinance. <br /> Section 16. Inspection Fees. Lynch shall pay to the City such usual and reasonable <br /> amounts as maybe required by the Director pursuant to City code for the City's inspection of the <br /> Covered Walkway. <br /> Section 17. Conflict. If the provisions of this Ordinance conflict with another provision <br /> of the Everett Municipal Code or any other City ordinance or regulation,the provisions of this <br /> Ordinance shall control. <br /> Section 18. Notices.
