' CITY OF EVERETT PUBLIC WORKS 00 72 13 SPECIAL PROVISIONS GENERAL CONDITIONS ' 9. Worker's Compensation a. A policy of Worker's Compensation, as required by the Industrial Insurance Laws of the State of Washington. b. As respects Workers' Compensation insurance in the state of Washington, Contractor shall secure its liability for industrial injury to its employees in accordance with the provisions of RCW Title 51. ' c. If Contractor is qualified as a self-insurer in accordance with RCW 51.14, Contractor shall so certify by letter signed by a corporate officer indicating that it is a qualified self insured, and setting forth the limits of any policy of excess insurance covering its employees. 10. Self-Insurance a. At its sole option and in its sole discretion, Owner may accept Contractor's self- insurance for a liability coverage in lieu of insurance from an insurer. t b. Contractor must provide a letter from its Corporate Risk Manager, or appropriate Finance Officer representing and warranting the following minimum information: whether the self-insurance program is actuarially funded; the fund limits; any excess ' declaration pages to meet the Contract requirements; a description of how Contractor would protect and defend the Owner as an Additional Insured in their Self-Insured layer;and claims-handling directions in the event of a claim. c. Any amounts due to, sought by, or paid to third party claimants shall be the sole l responsibility of the Contractor, irrespective of whether such amount falls wholly within the level or amount of the Contractor's self-insured retention. ARTICLE 16 LAWS, REGULATIONS AND PERMITS 16.1 General ' A. The Contractor shall give the Notices required by law and comply with all laws, ordinances,rules and regulations pertaining to the conduct of the Work. B. The Contractor shall be liable for violations of same in connection with Work provided by the ' Contractor; and Contractor shall cooperate with all governmental entities regarding inspection of the Work and compliance with such requirements. C. If the Contractor observes that the Drawings, Specifications or other portions of the Contract ' Documents are at variance with any laws, ordinances, rules or regulations, he or she shall promptly notify the Owner's Representative in writing of such variance. D. The Owner will promptly review the matter and,if necessary,take appropriate action. ' E. Contractor agrees not to perform Work it knows, or in the exercise of ordinary care should know, to be contrary to any laws,ordinances,rules or regulations. ' 16.2 Permits and Licenses A. Securing and Payment. 1. Unless otherwise specified, permits and licenses from governmental agencies, which are necessary only for and during the prosecution of the Work and the subsequent guarantee period, shall be secured by the Contractor and paid for by the Owner. 2. Permits and licenses of regulatory agencies that are necessary to be maintained after expiration of the guarantee period will be secured and paid for by the Owner.
