I <br /> I CITY OF EVERETT PUBLIC WORKS 00 21 13 <br /> SPECIAL PROVISIONS INSTRUCTIONS TO BIDDERS <br /> I 1. The City will award the Project to the responsive and responsible bidder whose Bid is the <br /> lowest. <br /> a. In accordance with RCW 39.04.380, if a bid is received from a nonresident <br /> contractor from a state that provides an in-state percentage bidding preference and <br /> I does not have an office located in Washington, then a comparable percentage <br /> disadvantage will be applied to the bid of that nonresident contractor. <br /> l 2. To determine Bidder responsiveness, City will consider all the material submitted by the <br /> bidder to determine whether it is in compliance with the Contract Documents. <br /> a. The City reserves the right,at its discretion,to reject nonresponsive Bids. <br /> I 3. Bidder shall meet all Mandatory Responsibility Criteria(RCW 39.04.350(1)) as follows: <br /> a. Have a current certificate of registration as a contractor in compliance with <br /> Chapter 18.27 RCW, which must have been in effect at the time of bid submittal; <br /> I and <br /> b. Have a current Washington Unified Business Identifier(UBI)number; and <br /> c. Have following State Requirements,if applicable <br /> 1) Have Industrial Insurance (workers' compensation coverage for bidder's <br /> employees working in Washington,as required in Title 51 RCW; and <br /> 2) Have a Washington Employment Security Department number, as required <br /> in Title 50 RCW; and <br /> I 3) Have a Washington Department of Revenue state excise tax registration <br /> number,as required in Title 82 RCW; and <br /> d. Not be disqualified from bidding on any public works contract under RCW <br /> I 39.06.010 or 39.12.065(3). <br /> e. Have not been found out of compliance by the Washington state apprenticeship <br /> and training council for working apprentices out of ratio, without appropriate <br /> supervision, or outside their approved work processes as outlined in their standards <br /> I of apprenticeship under chapter 49.04 RCW for the one-year period immediately <br /> preceding the date of the bid solicitation, if the Project is subject to the <br /> apprenticeship utilization requirements in RCW 39.04.320. <br /> 1 4. Bidder shall meet all Supplemental Bidder Responsibility Criteria (RCW 39.04.350(2)) <br /> as noted in Document 00 22 13 - Supplemental Instructions To Bidders. <br /> a. If there is no Document 00 22 13 - Supplemental Instructions To Bidders in the bid <br /> I package, then the Project is not subject to supplemental bidder responsibility <br /> criteria. <br /> I B. The City, in its sole discretion, reserves the right to accept or reject any and all bids submitted <br /> and to waive informalities and minor irregularities. <br /> I1.21 BID PROTESTS <br /> A.
