I <br /> CITY OF EVERETT PUBLIC WORKS 00 72 13 <br /> SPECIAL PROVISIONS GENERAL CONDITIONS <br /> tARTICLE 1 GENERAL INFORMATION <br /> 1.1 Definitions of Words and Terms <br /> A. Where used in the Contract Documents, the following words and terms shall have the meanings <br /> indicated. The meanings shall be applicable to the singular,plural, masculine and feminine of all <br /> words and terms. <br /> 1. Addenda: Written or graphic instruments issued prior to the opening of Bids that clarify, <br /> correct,or change the Bidding Requirements or the proposed Contract Documents. <br /> 2. Additive: A supplemental unit of work or group of bid items, identified separately in the Bid <br /> Form,that may,at the discretion of the City,be awarded in addition to the base Bid. <br /> 3. Alternative or Alternate: One of two or more units of Work or groups of bid items, <br /> identified separately in the Bid Form, from which the City may make a choice between <br /> different methods or material of construction for performing the same Work. <br /> 4. Application for Payment: Form acceptable to Owner that Contractor is to use during the <br /> course of the Work in requesting progress or final payments that is to be accompanied by <br /> such supporting documentation as is required by the Contract Documents. <br /> ' 5. Architect: An individual or entity retained by the Owner to be the Owners representative <br /> with regard to matters of design intent. The terms "Owner's Representative", "Engineer" <br /> and"Architect"are interchangeable. <br /> ' 6. Award Date: The date of the formal action by the Everett City Council to accept the lowest <br /> responsible and responsive Bidder for the Work. <br /> 7. Bid: The offer or proposal of a bidder submitted on the prescribed form setting forth the <br /> ' prices for the Work to be performed. <br /> 8. Bid Opening Date: The date the Everett City Clerk publicly opens and reads the Bids. <br /> 9. Change Order: Reference to Change Order shall include all rights of the Owner and <br /> Contractor under ARTICLE 6. CHANGES. <br /> 10. Completion Date: Date on which Project is ready for Final Acceptance. All physical <br /> Work, including Punch List, is complete and Contractor has completed and fulfilled all <br /> ' contractual obligations except any maintenance of landscaping. Contractual obligations that <br /> must be fulfilled prior to achievement of the Completion Date include,but are not limited to, <br /> the Contractor's furnishing all documentation (including correct, complete and accurate as- <br /> built or record drawings) and operation and maintenance manuals and transfer of warranties. <br /> 11. Contract: Agreement signed by the Owner and Contractor (DOCUMENT 00 60 13). <br /> Depending on context, "Contract"may also refer to the Contract Documents as a whole. <br /> 12. Contract Claim: Any request by the Contractor for additional time or money (adjustment <br /> of Contract Sum or Contract Time) irrespective of the cause or reason for the request. <br /> Contract Claims include, but are not limited to, requests by the Contractor for additional <br /> ' time or money due to Extra Work, inefficiencies, Delays, interferences, and problems with <br /> the design. Contract Claim includes, but is not limited to, claims or requests by <br /> Subcontractors for extensions of Contract Time, adjustment of Contract Sum, additional <br /> ' compensation that the Contractor attempts to pass through or assert against the Owner, or <br /> claims against the Owner arising out of a third party's claim against the Contractor. <br /> ' THREE LAKES VALVE BYPASS July 19, 2017 <br /> WO#UP3611 00 72 13 -5 <br />
