The State law changes relate to the severity of the crime when it is committed against <br /> a family or household member(Assault in the Fourth Degree Domestic Violence). <br /> Assault in the Fourth Degree Domestic Violence is a gross misdemeanor,punishable by a maximum penalty of <br /> 364 days in jail and a$5,000.00 fine. The State law update allows it to be prosecuted as a felony when the <br /> person committing the crime is a repeat-offender meeting the new statutory requirements. <br /> RECOMMENDATION(Exact action requested of Council): • <br /> Adopt an Ordinance Relating to Assault Domestic Violence, Amending Section 1 of Ordinance No. 1360-87 <br /> (Chapter 10.16.010 EMC). <br /> 15 <br />
