<br /> ✓ NPS - Service-Wide Conditions
<br /> These conditions apply to all commercial use authorizations and Special Use Permits in North
<br /> Cascades National Park, Ross Lake National Recreation Area, and Lake Chelan National Recreation
<br /> Area regardless of activity.
<br /> 1. The holder is prohibited from knowingly giving false information.To do so will be considered a
<br /> breach of conditions and be grounds for revocation: [RE: 36 CFR 2.32(a)(3)].
<br /> 2. The holder shall exercise this privilege subject to the supervision of the park area
<br /> Superintendent.The holder shall comply with all applicable laws and regulations of the area
<br /> and terms and conditions of the authorization.The holder must acquire all permits or licenses
<br /> of State or local government,as applicable, necessary to provide the services described above,
<br /> and, must operate in compliance with all applicable Federal, State,and local laws and
<br /> regulations, including,without limitation,all applicable park area policies,procedures and
<br /> regulations.
<br /> 3. This authorization is issued upon the express condition that the United States, its agents and
<br /> employees shall be free from all liabilities and claims for damages and/or suits for or by reason
<br /> of any injury, injuries, or death to any person or persons or property of any kind whatsoever,
<br /> whether to the person or property of the (holder),its agents or employees,or third parties,
<br /> from any cause or causes whatsoever while in or upon said premises or any part thereof during
<br /> the term of this authorization or occasioned by any occupancy or use of said premises or any
<br /> activity carried on by the (holder) in connection herewith,and the (holder) hereby covenants
<br /> and agrees to indemnify, defend, save and hold harmless the United States, its agents,and
<br /> employees from all liabilities, charges,expenses and costs on account of or by reason of any
<br /> such injuries, deaths, liabilities, claims,suits or losses however occurring or damages growing
<br /> out of the same.
<br /> 4. 4e holder agrees to carry general li�biiit�insurance again t claims occasioned by the action •
<br /> omi ions of the holder, its agents and employees in carrying out activities and operations
<br /> under •'s authorization.
<br /> a. Such i urance shall be in the amount commensurate with the degree of risk a : the scope
<br /> and size o uch activities authorized herein,but in any event,the limits of 1'. •ility shall not
<br /> be less than '.400,000 per occurrence covering both bodily injury and p : •erty damage. If
<br /> claims reduce a, ..ilable insurance below the required per occurren • imits,the holder
<br /> shall obtain additi• gal insurance to restore the required limits. A umbrella or excess
<br /> liability policy, in ado .'on to a comprehensive general habil'- policy, maybe used to
<br /> achieve the required lim .
<br /> b. The policy shall be underw ' ten by a United States pany naming the United States of
<br /> America National Park Service, orth Cascades . ional Park, 810 State Route 20, Sedro-
<br /> Woolley,Washington 98284 as a. •itional in .red. Holder agrees to have on file with the
<br /> park copies of the above insurance t: - proper endorsements.
<br /> c. The holder agrees to comply with any •• •sed insurance limits the Superintendent may
<br /> require during the term of this aut •rizati• 4.
<br /> d. If transporting clients,the hold: shall also o: .in automobile liability insurance to cover
<br /> all owned, non-owned, and •' ed vehicles.
<br /> e. The holder shall submit •cumentation of current •lid State vehicular registration and
<br /> insurance coverage each vehicle used if the holder' transporting clients within North
<br /> Cascades Natio 'ark Complex boundaries.
<br /> f. The holder • .11 provide the Superintendent with a Stateme . of Insurance and Certificate
<br /> of Insur, ce at the inception of this authorization and annually 'ereafter,and shall
<br /> pro :e the Superintendent thirty (30) days' advance written noti of any material change
<br /> the holder's insurance program hereunder.
