EV i I Z <br /> ORDINANCE No. 3567-171. <br /> AN ORDINANCE Relating to Criminal Mistreatment,Amending Ordinance No. 2468-00 <br /> as Amended and Ordinance No. 2621-02 (Chapter 10.19 EMC). <br /> Whereas, the City of Everett has the power to provide for the punishment of all practices <br /> dangerous to public health or safety and to provide for the punishment of all persons charged <br /> with violating any city ordinances; and <br /> Whereas, State law relating to the crimes of Criminal Mistreatment in the Third and <br /> Fourth Degree (Chapter 10.19.020 and .025 EMC),Abandonment of a Dependent Person in the <br /> Third Degree(Chapter 10.19.060), and related definitions and sections, have been amended, <br /> including the most recent update in 2017 by Engrossed Substitute House Bill 1153; and <br /> Whereas, State law changes in Engrossed Substitute House Bill 1153 will cause criminal <br /> conduct that used to be a gross misdemeanor under Criminal Mistreatment in the Third Degree to <br /> instead be felony Criminal Mistreatment; and <br /> Whereas, the Everett City Council deems it appropriate for the Chapter 10.19 EMC <br /> Criminal Mistreatment to be amended, in light of changes to State law; <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 1 of Ordinance No. 2648-00, as amended by Section 1 of Ordinance No. <br /> 2620-02 (EMC 10.19.010), which reads as follows: <br /> Definitions. <br /> The definitions in this section apply throughout this chapter unless the context clearly requires <br /> otherwise. <br /> A. "Basic necessities of life"means food, water, shelter, clothing, and medically necessary <br /> health care, including but not limited to health-related treatment or activities,hygiene, oxygen, <br /> and medication. <br /> B. 1. "Bodily injury" means physical pain or injury, illness, or an impairment of physical <br /> condition; <br /> 2. "Substantial bodily harm"means bodily injury which involves a temporary but substantial <br /> disfigurement, or which causes a temporary but substantial loss or impairment of the function of <br /> any bodily part or organ, or which causes a fracture of any bodily part. <br />
