D �MAR 1 31989 <br /> ........................................ ............................ <br /> CITY OF EVERETT <br /> BOARD OF ADJUSTMENT Public Works Dept. <br /> FINDINGS, CONCLUSIONS, AND ORDER <br /> VARIANCE NO. 3-89 <br /> Based upn the written request for a variance from the City's <br /> zoning code by: <br /> Dean Lozano <br /> 2312 19th St. <br /> Everett, WA 98201 1 <br /> hereinafter referred to as "Applicant", for a variance from <br /> E.M.C. 19.40.020, Off-Street Parking to allow less than the eight <br /> off-street parking spaces required by code for a nonconforming <br /> use in a nonconforming building. <br /> Location of Proposal: 1902 Virginia <br /> The Board of Adjustment, following a public hearing on said ap- <br /> plication held on March 6, 1989, and further having reviewed all <br /> testimony, makes the following Findings, Conclusions and Order: <br /> rINDINGS AND CONCLUSIONS• <br /> CRITERION NO, 1• <br /> That there have been exceptional or extraordinary circusstances <br /> or conditions applying to the subject property or as to the in- <br /> tended use thereof that do not apply generally to other <br /> properties in the same vicinity or zone <br /> FINDING: The property consists of a 3,120 square foot, <br /> two-story, flat roofed, existing commercial <br /> structure constructed in the early 1900's as a <br /> grocery store on a 3000 square foot lot. The <br /> building was later remodeled, adding an <br /> apartment on the second floor and one on the <br /> first floor, leaving 770 square feet for the <br /> grocery on the first floor. <br /> In 1961 the grocery store was converted to a <br /> beauty shop. The beauty shop use was a less <br /> intensive use than the grocery store since it <br /> was a one person shop and the parking require- } <br /> ment would have been for a total of five <br /> spaces, three for the residential use and two <br /> for the beauty shop. Since there were only <br /> two off-street parking spaces on the site, the 6 <br /> parking was nonconforming by three spaces. ! <br /> In 1987 the beauty shop was changed to the <br /> present use, which is the "Children's Attic" a <br /> second hand children's clothing store, where <br /> children's clothing is sold on consignment. <br /> When the Applicant applied for a business <br /> license the City became aware that the parking <br /> requirement was not being met. <br /> The parking requirement for this use is for a <br /> total of eight spaces, three for the residen- <br /> tial use and five for the retail use. <br /> It has been City policy to allow credit for a <br /> previous nonconformity in calculating the <br /> parking requirement when a use changes, so be- <br /> cause of the previous use's nonconformity of <br /> three spaces, the total parking requirement <br /> for the Children's Attic and two apartment <br /> units would be five spaces. <br />
