The Applicant is proposing to construct two <br /> additional off-street parking spaces south of <br /> the building which will then have a total of <br /> four off-street parking spaces which is one <br /> less than required. Because of the small size <br /> of the lot (3,000 square feet) in relationship <br /> to the size of the building (3,120 square <br /> feet) , there is no space on the site to pro- <br /> vide additional parking. <br /> Most of the customers of the Children's Attic <br /> live in the neighborhood and so most of the <br /> traffic is "walk in" by residents of the area. <br /> QQNCI,USIONI There are unusual and extraordinary circum- <br /> stances applying to the property and to the y <br /> proposed use of the property because of the <br /> fact that it is a nonconforming use and build- <br /> ing in existence since the early 1900's and <br /> because the intensity of use is less than the <br /> usual retail use. <br /> CRITERION NO, 2L <br /> That such variance is necessary for the preservation and enjoy- <br /> ment of a substantial property right of the appellant possessed <br /> by the owners of other properties in the same vicinity or zone. <br /> pINDING:_ There are other nonconforming uses in the vi- <br /> cinity and zone that do not provide parking to <br /> code. <br /> QQN LU,9J 1i:. Granting this variance is necessary in order <br /> for the Applicant to enjoy a substantial prop- <br /> erty right enjoyed by others in this vicinity <br /> and zone. <br /> CRT ION NO, 3:, <br /> That the authorization of such variance will not be materially <br /> detrimental to the public welfare or injurious to property in <br /> the vicinity or zone in which the property is located. <br /> gSNDINGS: The building has been in existence since 1919 . <br /> and so is a fixture in the neighborhood that <br /> all residents were aware of when purchasing <br /> their property. The surrounding area consists <br /> of older, well maintained single family struc- <br /> tures that appear to have the potential for <br /> continuing in the same type of use for many <br /> years, so major changes are not anticipated in <br /> this neighborhood in the near future. <br /> No adverse comments have been received in re- , <br /> sponse to notice sent to property owners <br /> within 300 feet of the project site and no ad- <br /> verse comments have been received from cther <br /> city departments. <br /> The Children' Attic provides a service to the <br /> area by providing low cost children's clothing <br /> and also "penny" candy to the children of the <br /> neighborhood. <br /> CONCLUSIONi It does not appear that the authorization of <br /> this variance would be materially detrimental <br /> to the public welfare or injurious to property <br /> in the vicinity and zone. <br /> -2- <br />
