7. Agreed Order <br /> If the respondent is not a Repeat Violator (see Paragraph 1) and has completed the <br /> minimum corrective action described in this citation, he/she is eligible to enter into an <br /> agreed order with the city. The agreed order means that the city agrees that it will not <br /> take further action against the respondent regarding the violations described in this <br /> citation as long as there are no further nuisance-related EMC violations for the two-year <br /> period following the date of the order. <br /> If the Respondent is eligible to enter into an agreed order with the city, and signs the <br /> agreed order, the Respondent is no longer required to appear at the hearing set forth in <br /> Paragraph 6. The Code Officer listed below must be contacted to schedule an <br /> inspection of the property if the Respondent wishes to apply for an agreed order. <br /> NOTHING HEREIN REA..IEVES F'ESPONDENTS FROM THEIR OBLIGATIOM TO <br /> COMPLY WITH ALL APPLICABLE CODES <br /> 8. Hearing Examiner <br /> Following the hearing, the Violations Hearing Examiner may issue an order against the <br /> Respondent, even if he/she does not attend the hearing. The <br /> Hearing Examiners' Order may: <br /> A. Require that the violations be corrected by a specific date; <br /> B. Impose a monetary penalty in accordance with Chapter 1.20 EMC; <br /> C. Authorize the City to enter the property, correct the violations and to assess <br /> the costs of the corrections, as permitted by law. <br /> The City will make the Proposed Order and the exhibits available to the Respondent one <br /> business day prior to the hearing. To obtain a copy please contact the undersigned <br /> Code Enforcement Officer at least two business days in advance to allow for the <br /> preparation of the exhibits. Documents can be picked up at the Police Department <br /> Records Unit counter located on the first floor at 3002 Wetmore Avenue.
