• <br /> ORDINANCE NO. 1765-91 <br /> AN ORDINANCE amending Section 44(D) of Ordinance No. 1671-89, the <br /> City's Zoning Code, extending the effective date of <br /> Section 37 (Environmentally Sensitive Areas) until <br /> September 1 , 1991 . <br /> WHEREAS, the City of Everett adopted a new Zoning Code (Ordinance No. <br /> 167189) which became effective on January 15, 1990; and <br /> WHEREAS, the City Council declared that Section 37 of the Zoning Code <br /> pertaining to environmentally sensitive areas was interim and would be valid <br /> for a period of one year, until January 15, 1991 , so the Planning Commission <br /> could review and revise existing adopted policies related to environmentally <br /> sensitive areas, consider technical and scientific information related to <br /> environmentally sensitive areas, and consider State mandated programs <br /> related to environmental concerns; and <br /> WHEREAS, the Planning Commission has been holding a series of public <br /> workshops to consider information and testimony concerning environmentally <br /> sensitive areas; and <br /> WHEREAS, the Planning Department staff has produced a draft Element of the <br /> Everett General Plan pertaining to environmentally sensitive areas and a <br /> draft revision to Chapter 37 of the Zoning Code; and <br /> WHEREAS, it is apparent that the public participation and environmental <br /> review processes required for the consideration of comprehensive plan and <br /> zoning ordinance revisions will not be concluded prior to the January 15, <br /> 1991 , expiration date of Section 37 of the Zoning Code; and <br /> WHEREAS, the State Growth Management Act, HB 2929, requires that cities and <br /> counties adopt regulations for the protection of "critical areas" <br /> (environmentally sensitive areas) by September 1 , 1991 , and that such <br /> regulations be consistent with the guidelines that are established by the <br /> State Department of Community Development; and <br /> WHEREAS, additional time is needed to prepare the permanent environmentally <br /> sensitive areas section of the Zoning Code; and <br /> WHEREAS, the Planning Commission recommends that the effective date of <br /> Section 37 of the Zoning Code be extended until September 1 , 1991 ; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />
