ORDINANCE NO. 1754-90 1 2 3 AN ORDINANCE amending Section 18 of Ordinance No. 1670-89 extending the interim traffic mitigation policy for the 4 City of Everett. 5. 6 WHEREAS, the City Council finds that on December 27, 1989, the City 7 Council passed Ordinance No. 1670-89 establishing an interim traffic 8 mitigation policy for the City of Everett; and 9 WHEREAS, the City Council finds that Section 18 of Ordinance No. 10 1670-89 established that said ordinance would be effective until 11 December 31 , 1990; and 12 WHEREAS, the City Council finds that the purpose of the interim traffic 13 mitigation policy is to act as a stop-gap measure while the City develops a 14 permanent traffic mitigation ordinance; and 15 WHEREAS, the City Council finds that the City has been working towards 16 the development of a permanent traffic mitigation ordinance; and 17 WHEREAS, the City Council finds that there has been uncertainty 18 concerning the possible regulatory framework for the permanent traffic 19 mitigation ordinance due to the dilemma brought about by Substitute House 20 Bill No. 2929 and Initiative 547; and 21 WHEREAS, the City Council finds that the City needs additional time to 22 prepare the permanent traffic mitigation ordinance; and 23 WHEREAS, the City Council finds that the interim traffic mitigation 24 policy should be extended to provide for this needed time; and 25 WHEREAS, the City Council finds that the interim traffic mitigation 26 policy provides a reasonable and appropriate basis for requiring mitigation 27 of adverse impacts under the City' s substantive authority; 28 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 29 Section 1 : Section 18 of Ordinance No. 1670-89 which reads as follows: 30 The Council finds that this ordinance is necessary for the 31 immediate preservation of the public peace, health and safety and the public welfare. This ordinance shall remain in effect until 32 December 31 , 1990.
