ORDINANCE NO. 1754-90 <br /> 1 <br /> 2 <br /> 3 AN ORDINANCE amending Section 18 of Ordinance No. 1670-89 <br /> extending the interim traffic mitigation policy for the <br /> 4 City of Everett. <br /> 5. <br /> 6 <br /> WHEREAS, the City Council finds that on December 27, 1989, the City <br /> 7 Council passed Ordinance No. 1670-89 establishing an interim traffic <br /> 8 mitigation policy for the City of Everett; and <br /> 9 WHEREAS, the City Council finds that Section 18 of Ordinance No. <br /> 10 1670-89 established that said ordinance would be effective until <br /> 11 December 31 , 1990; and <br /> 12 WHEREAS, the City Council finds that the purpose of the interim traffic <br /> 13 mitigation policy is to act as a stop-gap measure while the City develops a <br /> 14 permanent traffic mitigation ordinance; and <br /> 15 WHEREAS, the City Council finds that the City has been working towards <br /> 16 the development of a permanent traffic mitigation ordinance; and <br /> 17 WHEREAS, the City Council finds that there has been uncertainty <br /> 18 concerning the possible regulatory framework for the permanent traffic <br /> 19 mitigation ordinance due to the dilemma brought about by Substitute House <br /> 20 Bill No. 2929 and Initiative 547; and <br /> 21 WHEREAS, the City Council finds that the City needs additional time to <br /> 22 prepare the permanent traffic mitigation ordinance; and <br /> 23 WHEREAS, the City Council finds that the interim traffic mitigation <br /> 24 policy should be extended to provide for this needed time; and <br /> 25 WHEREAS, the City Council finds that the interim traffic mitigation <br /> 26 policy provides a reasonable and appropriate basis for requiring mitigation <br /> 27 of adverse impacts under the City' s substantive authority; <br /> 28 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 29 Section 1 : Section 18 of Ordinance No. 1670-89 which reads as follows: <br /> 30 The Council finds that this ordinance is necessary for the <br /> 31 immediate preservation of the public peace, health and safety and <br /> the public welfare. This ordinance shall remain in effect until <br /> 32 December 31 , 1990. <br />
