2. Where a nuisance exists, the City Attorney on behalf of <br /> the City is authorized to institute injunction, mandamus, <br /> or other appropriate action or proceeding to prevent the <br /> violation of the UFC. <br /> 3. Notwithstanding paragraph (2) , the City Attorney is <br /> authorized to apply to any court of competent jurisdiction <br /> for and such court, upon hearing and for cause shown, may <br /> grant a temporary or permanent injunction restraining any <br /> person, firm and/or corporation from violating any <br /> provision of the UFC. <br /> 4. A conviction of any person, firm or corporation for <br /> violating the UFC shall not impede the authority granted <br /> in this section to the City Attorney or City. <br /> D. The 1988 Edition of the UFC is amended by the addition of the <br /> following: <br /> Fire Marshal Order <br /> 1. The Fire Chief or his designee hereby has the authority to <br /> order dangerous structures, buildings, places, conditions, <br /> or materials to be removed, corrected, vacated or <br /> demolished in such manner as shall be set forth in an <br /> order, which shall be in substantially the following form: <br /> FIRE MARSHAL ORDER <br /> City of Everett <br /> To: <br /> (Name of party to whom order is issued and description of premises or places <br /> by street address. ) <br /> You, and each of you, are hereby notified by the undersigned Fire Marshal <br /> that an inspection of the premises or place above-described was made on <br /> the day of , 199_. at which time there <br /> was found upon said above-described premises or place conditions <br /> particularly dangerous to the safety of persons and property and especially <br /> liable to fire or spread of fire.
