• <br /> 3. If the buildings or other premises are owned by one person and <br /> occupied by another under a lease or leasehold agreement or <br /> otherwise, the orders issued in connection herewith shall apply to <br /> the occupant or tenant thereof, provided that if the person on whom <br /> the order is served is a tenant or occupying such premises under a <br /> lease or leasehold agreement or otherwise, then such individual <br /> shall be deemed to have complies with the Fire Marshal Order if the <br /> said tenant or lessee immediately closes and secures such a <br /> building, causes said premises after receipt of such Fire Marshal <br /> Order and takes such steps as may be reasonable to remove <br /> accumulations of combustible, explosive or otherwise hazardous <br /> materials. <br /> 4. Any such Fire Marshal Order shall be forthwith complied with as set <br /> forth in said order within the time or times therein prescribed. <br /> Any person upon whom such order is served, may take an appeal of <br /> such order and seek review thereof with the Board of Appeals, <br /> provided such appeal is filed within thirty (30) calendar days <br /> after service of such order. <br /> 5. In the event that any such person seeking a review before the Board <br /> of Appeals fails to comply with all of the steps herein set forth, <br /> then any member of said Board of Appeals or the City Attorney for <br /> the City of Everett may dismiss such appeal upon motion and if all <br /> of the steps for appeal have not been complied with, the appeal of <br /> such party shall be dismissed by the Board of Appeals. All <br /> decisions of the Board of Appeals shall be final. <br /> E. Section 78.102(b) of the 1988 Editions of the UFC is hereby amended <br /> by deleting: <br /> (b) Except as hereinafter provided, it shall be unlawful for <br /> any person to possess, store, to offer for sale, expose for <br /> sale, sell at retail or use or explode any fireworks, provided <br /> that the Chief shall have power to adopt reasonable rules and <br /> regulations for the granting of permits for supervised public <br /> displays of fireworks by a jurisdiction, fair association, <br /> amusement park, other organization or for the use of fireworks <br /> by artisans in pursuit of their trade. Every such use or <br /> display shall be handled by a competent operator approved by <br /> the Chief and shall be of such character and so located, <br /> discharged or fired so as, in the opinion of the Chief after <br /> proper investigation, not to be hazardous to property or <br /> endanger any person. <br /> and inserting in its place: <br />
