1 ORDINANCE NO. 1741-90 <br /> 2 AN ORDINANCE authorizing and establishing procedures for sale of <br /> timber on City utility property. <br /> 3 <br /> 4 WHEREAS, the City' s participation in the Wildlife Habitat Management <br /> 5 Plan of the Henry M. Jackson Project requires by Federal Energy Regulatory <br /> 6 Commission approval order that half of the City's Lake Chaplain property be <br /> 7 managed on a sixty (60) year harvest rotation to enhance habitat conditions <br /> 8 for a wide range of wildlife species while protecting water quality; and <br /> 9 WHEREAS, the water system of the Utilities Division owns said property <br /> 10 used for watershed control and management on which merchantable timber may <br /> 11 be removed and sold to benefit utility operations; and <br /> 12 WHEREAS, the City Council finds that the timber should be sold to the <br /> 13 highest bidder with a proven record of compliance with environmental water <br /> 14 quality protection requirements under lump sum contracts without restriction <br /> 15 as to sales outlets, after public notice and call for bids; and <br /> 16 WHEREAS, pursuant to Section 15.8 of the Everett City Charter, at least <br /> 17 three (3) days notice of the authorization and procedures provided by this <br /> 18 ordinance has been given to City appointive officers and their <br /> 19 recommendations have been reviewed; <br /> 20 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 21 Section 1 : The Utilities Division of the Department of Public Works <br /> 22 shall prepare a schedule of sales of timber on City property. Although the <br /> 23 size, location, and terms of said sales shall be planned to comply with the <br /> 24 Jackson Project Wildlife Management Plan and to maximize profit to the City, <br /> 25 the primary and overriding policies in the administration of said sales <br /> 26 shall be to protect the quality of the City's water supply. Accordingly, <br /> 27 award of a sale shall be made to the highest bidder demonstrating the most <br /> 28 experience and the best record in water quality protection: including <br /> 29 erosion control , site cleanup and rehabilitation, sanitation, etc. <br /> 30 Section 2: Council shall by resolution authorize the call for bids, <br /> 31 notice of which shall be advertised once a week for three (3) consecutive <br /> 32 <br />
