DELIVERY. Printed bonds will be furnished by the City and <br /> will be delivered to the purchaser in the City of Seattle, <br /> Washington, at the expense of the City, or elsewhere as may be <br /> mutually agreed upon at the purchaser's option and expense. <br /> Accrued interest to the date of delivery shall be paid by the <br /> purchaser at the time of delivery. <br /> The approving legal opinion of Preston Thorgrimson Shidler <br /> Gates & Ellis will be printed on the Bonds and will be furnished, <br /> without cost, to the successful bidder at the time of delivery. <br /> The obligations hereunder to deliver and accept the Bonds shall <br /> be conditioned on the availability and delivery at the time of <br /> delivery of such Bonds of said approving opinion, and of a certi- <br /> ficate, in form and tenor satisfactory to said law firm and dated <br /> as of the date of such delivery, to the effect that there is no <br /> litigation pending or (to the knowledge of the signer or signers <br /> thereof) threatened affecting the validity of such Bonds. <br /> SETTLEMENT. Payment for the Bonds shall be made in Federal <br /> funds available on the date and at the place of delivery of such <br /> Bonds. <br /> CUSIP NUMBERS. It is anticipated that CUSIP identification <br /> numbers will be printed on the Bonds, but neither the failure to <br /> print such number on any bond nor any error with respect thereto <br /> shall constitute cause for a failure or refusal by the purchaser <br /> thereof to accept delivery of and pay for said Bonds in <br /> accordance with the terms of its bid. All expenses in relation <br /> to the printing of CUSIP numbers on said Bonds shall be paid for <br /> by the City; provided, however, that the CUSIP Service Bureau <br /> charge for the assignment of said numbers shall be the <br /> responsibility of and shall be paid for by the purchaser. <br /> OFFICIAL STATEMENT. The Preliminary Official Statement <br /> dated , 1990 is deemed final within the meaning <br /> of Rule 15c2-12 of the Securities and Exchange Commission except <br /> for certain information ' related to pricing of Bonds. The City <br /> will furnish to the successful bidder through its designated <br /> senior representative at the expense of the City within seven (7) <br /> business days after the Sale Date a sufficient number of copies <br /> of the Official Statement to enable the successful bidder to <br /> comply with applicable rules of the Securities and Exchange <br /> Commission and the Municipal Securities Rulemaking Board. <br /> FURTHER INFORMATION.
